Caribou-coffee

Caribou Coffee Inc. has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act by sending text messages to mobile phone numbers without the prior express written consent of the recipients.

If you received one or more text messages from Caribou Coffee between May 5, 2012 and July 28, 2017, you may be entitled to a cash payment from the TCPA class action settlement.

The Telephone Consumer Protection Act is a federal law that restricts telephone solicitations and the use of automated telephone equipment to make phone calls and send text messages. Under the TCPA, businesses are prohibited from sending marketing text messages and other types of phone messages without the prior express written consent of the recipient.

Plaintiff Kristie Farnham alleges that she received approximately 50 text messages from Caribou Coffee beginning in March 2016. She maintains she never provided her express written consent to receive such communications.

According to the Caribou Coffee TCPA class action lawsuit, the text messages were sent using an automated telephone dialing system that is capable of making numerous calls and/or texts simultaneously.

Farnham’s Caribou Coffee class action lawsuit sought statutory damages of $500 to $1,500 for each text message that violated the TCPA.

Caribou Coffee denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation. In addition to providing compensation to eligible Class Members, Caribou Coffee has also agreed to discontinue its text message marketing programs.

Class Members who would like to opt out of or object to the Caribou Coffee settlement must do so no later than Oct. 13, 2017.

Who’s Eligible

Class Members include anyone residing in the United States who, between May 5, 2012 and July 28, 2017, received one or more text messages sent to their cell phone number by or on behalf of Caribou Coffee.

Potential Award

To be determined. The Caribou Coffee settlement fund will be distributed on a pro rata basis to all Class Members who submit timely and valid claims. The amount each claimant will receive depends on the total number of valid claims filed.

Proof of Purchase

N/A. Class Members must provide the cell phone number that received the unwanted text messages from Caribou Coffee and declare under the penalty of perjury that they received at least one text message from Caribou between May 5, 2012 and July 28, 2017.

    1. Top Class Actions says:

It was. All verified claims received $68 and change. The amount was based upon the number of valid claims submitted.

  8. Nikol Cholaj says:

Just to let everyone know i finally got a call back from the caribou settlement administrator today and so she said there are still appeals going on even tho it says final approval was made in November.. So after all the appeals are done and finalized they have 180 days to mail out the checks so looks like no checks for atleast 180 days from whenever the appeals end

    1. Angela says:

Thank you for the update. I’ve been wondering what’s taking so long!

    2. Top Class Actions says:

The appeal was filed after the deadline (44 days after Effective Date, deadline is 30 days), and according to court documents was voluntarily dismissed on 2/21/18.

      1. JJ says:

So does that mean that payments will be made sometime in the next 180 days from yesterday?

      2. Nikol Cholaj says:

So what r u saying then about the appeals? Because i recieved a call from the claims addministration person at caribou coffee and thays what she told me on the date i posted it on here was that its still not all the way finalized until all appeals and everything is done which she has no idea when that will b but after then there is still 180 to send out payments

        1. Top Class Actions says:

We posted what we saw on the court docket, and what we read in the court approved settlement agreement. If the settlement administrator states that it could be 180 days before payments are mailed, then that could very well be the case. But, the court docket is showing the appeal dismissed, and the settlement agreement states that claims will be paid 45 days after the Effective Date.

    3. Justin says:

I got a 68 dollar check from caribou today.

  9. Liz says:

    Thanks for the update.

  10. JAz says:

Have not received a response or check. I’ve called and messaged in FB group.

    1. Top Class Actions says:

Claims have not yet been paid, but hopefully by the end of this month!
