Top Class Actions viewers are reportedly receiving checks for $68.56 from a Caribou Coffee TCPA class action settlement over allegations that they received unwanted text messages from the coffee company.
Lead plaintiff, Kristie Farnham, alleged in her class action lawsuit that she and others received numerous unsolicited text messages from Caribou Coffee.
According to the Caribou Coffee class action lawsuit, the plaintiff received up to 50 text messages starting in March 2016 from the coffee company, that were sent without her permission.
In June of last year, Caribou Coffee agreed to settle the class action lawsuit and pay $8.5 million to a Class of consumers who received the unwanted messages. The move came after the coffee company failed to dodge the class action lawsuit or at least put litigation on hold over federal interpretation of the Telephone Consumer Protection Act (TCPA).
According to the Top Class Actions Facebook page, Class Members who filed valid claims for the Caribou Coffee TCPA class action settlement began receiving checks starting on March 1. If you filed a valid claim for this settlement, keep your eye on your mailbox because checks are arriving.
The TCPA was enacted in the early 1990s to protect consumers from use of auto dialers and other electronic advertising unless they provide permission. The Act makes it illegal for companies to make unsolicited calls and send unwanted text messages to consumers. Violations carry steep fines from $500 to $1,500 per violation.
Caribou Coffee said it wanted to avoid the expense and burden of further litigating the class action lawsuit, but did not admit to any violations of the TCPA under the terms of the settlement. The class action alleged that Caribou Coffee launched a loyalty program in 2014 that asked consumers to text a word or visit a website to earn “rewards.” However, the company used an autodialer to send the messages in violation of the TCPA, according to the class action.
Class Members included “all individuals in the United States who received one or more unsolicited text messages from or on behalf of Caribou Coffee Company, Inc., between May 5, 2012, and July 28, 2017.”
The deadline to file a claim passed on Nov. 13, 2017.
