HSBC Technology & Services (USA) Inc. and HSBC Card Services Inc. have agreed to pay $13 million to settle three class action lawsuits that allege they violated California law by recording phone calls without notifying consumers.
California residents who received a telephone call from or on behalf of HSBC Card Services between March 23, 2009 and May 1, 2012 that was recorded or monitoredmay be entitled to benefits from the class action settlement.
The HSBC class action lawsuits allege HSBC placed calls to consumers and monitored or recorded the calls without obtaining consent from the call recipients. These calls allegedly involved confidential telephone conversations with California credit card account holders.
The plaintiffs allege the calls from HSBC violated the California Invasion of Privacy Act, which prohibits certain intentional recordings of phone calls without the consent of all parties to the conversation. Statutory penalties for violations of CIPA are $5,000 per call.
HSBC denies any wrongdoing but agreed to settle the call recording class action lawsuits to avoid the burden and expense of ongoing litigation. The settlement will resolve three HSBC class action settlements that are pending in California federal court.
If you would like to opt out of or object to the HSBC class action settlement, you must do so no later than Aug. 28, 2017.

Class Members include: “All persons in California who received a telephone call between March 23, 2009 and May 1, 2012 from or on behalf of HSBC Card Services Inc. and whose call was recorded or monitored by or on behalf of HSBC.”

Just received my check for $7.11 in California.
Received a check in California for a whopping $4.45 last Thursday. Seems a rather small amount, so I suppose I must have ended up on the least payable list as I understand it. Still, every little bit helps and I am appreciative for at least some kind of compensation for HSBC’S unlawful practices.

My mail showed the check should of been in my mailbox but it was not. I think it was put in someone else’s mailbox by accident. How do i stop payment and get another check before this shady person cashes the check?

I see one coming in my informed delivery for today but, not too excited with people saying they’ve only received $4.25. Why were the checks so low, given the amount of this settlement?

The amount is per call, and is based upon the number of verified claims submitted.
