The TJX Companies Inc. has agreed to a $8.5 million class action settlement over allegations that T.J. Maxx, HomeGoods, and Marshalls stores use misleading price tags.
Customers who purchased one or more items from a T.J. Maxx, Marshalls, or HomeGoods store in California between July 17, 2011 and Dec. 6, 2017, can file a claim to receive either a merchandise store credit or cash from this class action settlement.
The T.J. Maxx class action lawsuit, filed in July 2015, alleged T.J. Maxx’s use of the phrase “Compare At” on price tags was deceptive. Plaintiffs Staci Chester and Daniel Friedman argued that the “Compare At” prices were false and misleading about the actual price of comparable items at other stores.
The class action lawsuit says comparative pricing used at T.J. Maxx, HomeGoods, and Marshalls deceives consumers into falsely believing they are saving considerable amounts on items purchased.
While the T.J. Maxx website defined the “Compare At” price as buying staff’s estimate, the actual price tags include no such explanation. The lawsuit charged T.J. Maxx with unfair business practices, fraudulent business practices, unlawful business practices, false advertising, and with violating California’s Consumer Legal Remedies Act.
Class Members who submit a valid claim will receive a TJX Merchandise Credit. The amount of the credit will be determined by the total number of claims filed. The credit will be valid only in California stores. Claimants will have the option of exchanging an unused Merchandise Credit for cash in the amount equal to 75 percent of the credit.
TJX Companies also agreed to change pricing disclosures on its website and on signs in California stores, and to take additional measures to ensure the company complies with California’s price comparison advertising regulations.
The T.J. Maxx deceptive pricing class action settlement was granted preliminary approval on Dec. 5, 2017. Class Members have until April 9, 2018 to object or opt out of the settlement.
Who’s Eligible
All persons who purchased one more items from a T.J. Maxx, Marshalls, or HomeGoods store in California between July 17, 2011 and Dec. 6, 2017, with a TJX price tag that included a “Compare At” price, and who have not received a refund or credit for all of their purchases.
Potential Award
TJX Merchandise Credit.
Class Members who file a valid and timely claim will receive a TJX Merchandise Credit. The amount of the credit will be pro rata, based upon the money left in the $8.5 million settlement fund after court-approved fees and expenses. Unused Merchandise Credits may be returned to the settlement administrator and exchanged for cash in an amount equal to 75 percent of the credit.

It’s funny, I am sure more then half of these people complaining about not receiving their funds, have no business even receiving the funds in the first place. Give me a break, and stop complaining, it’s free money, do you really need to complain about $27 dollars ? Really? OMG
I mailed my gift cards in to exchange for money and I have not heard anything else
Card can only be redeemed in CA , cannot be used for online purchases.
However, there is an option to return your card to the claims admin for 70% of the cards value in a check.
–I did this and never heard back from them. So essentially they stole from me, again

Gift card for the cash option with them Administrator confirming receipt of paperwork mid Dec 2018. Have exchanged multiple emails and phones calls, bottom line …given the runaround. And to charged a $7 fee for the check v gift card option, and still waiting 4 months? All because there is not a brick and mortar store accessble!
Informed delivery shows that I’m getting something from this settlement again today. I already received my gift card so I’m not sure what this could be.

Extremely frustrated with this payout process. I received a gift card and because I am unable to shop in-store, retuned the unused gift card to the Admin for a cash payment, less a hefty fee, per instructions on the payout letter. It’s been one month and no check! I emailed an update request and received a wait two weeks for processing and mailing. After one month I assume I will not receive any closure to this, Very disheartening.
I opted out of this class action as I believe I am due far more money than what the class members will be receiving. I spent upwards of 18k in their stores since 2011 to current and am working with their attorney trying to get a refund of .75 for every dollar I spent. I’m I incorrect in my belief that this is what is owed to me? Their lawyer is telling me that they only owe me $500. unless I hire an attorney to speak with their attorney. I told TJX Co’s attorney that am trying to avoid hiring an attorney as it will be more costly for them and take longer to file another lawsuit, in which case, if there is an attorney out there reading this, please email Jetta tanner at g mail dot com.
