The TJX Companies Inc. has agreed to a $8.5 million class action settlement over allegations that T.J. Maxx, HomeGoods, and Marshalls stores use misleading price tags.
Customers who purchased one or more items from a T.J. Maxx, Marshalls, or HomeGoods store in California between July 17, 2011 and Dec. 6, 2017, can file a claim to receive either a merchandise store credit or cash from this class action settlement.
The T.J. Maxx class action lawsuit, filed in July 2015, alleged T.J. Maxx’s use of the phrase “Compare At” on price tags was deceptive. Plaintiffs Staci Chester and Daniel Friedman argued that the “Compare At” prices were false and misleading about the actual price of comparable items at other stores.
The class action lawsuit says comparative pricing used at T.J. Maxx, HomeGoods, and Marshalls deceives consumers into falsely believing they are saving considerable amounts on items purchased.
While the T.J. Maxx website defined the “Compare At” price as buying staff’s estimate, the actual price tags include no such explanation. The lawsuit charged T.J. Maxx with unfair business practices, fraudulent business practices, unlawful business practices, false advertising, and with violating California’s Consumer Legal Remedies Act.
Class Members who submit a valid claim will receive a TJX Merchandise Credit. The amount of the credit will be determined by the total number of claims filed. The credit will be valid only in California stores. Claimants will have the option of exchanging an unused Merchandise Credit for cash in the amount equal to 75 percent of the credit.
TJX Companies also agreed to change pricing disclosures on its website and on signs in California stores, and to take additional measures to ensure the company complies with California’s price comparison advertising regulations.
The T.J. Maxx deceptive pricing class action settlement was granted preliminary approval on Dec. 5, 2017. Class Members have until April 9, 2018 to object or opt out of the settlement.
Who’s Eligible
All persons who purchased one more items from a T.J. Maxx, Marshalls, or HomeGoods store in California between July 17, 2011 and Dec. 6, 2017, with a TJX price tag that included a “Compare At” price, and who have not received a refund or credit for all of their purchases.
Potential Award
TJX Merchandise Credit.
Class Members who file a valid and timely claim will receive a TJX Merchandise Credit. The amount of the credit will be pro rata, based upon the money left in the $8.5 million settlement fund after court-approved fees and expenses. Unused Merchandise Credits may be returned to the settlement administrator and exchanged for cash in an amount equal to 75 percent of the credit.

jetta, first of all, who spends 18k at a TJMaxx? So that alone is hard to believe. Also unless you have receipts for every purchase you made at the TJ Maxx stores in CA to add up to 18k dollars, you don’t have a case at all. I would stop wasting your time. If you do have receipts for every purchase and proof that you really spent that much at the stores during those times and locations, I would find a lawyer, that can go to court and get you back the money you lost and the cost of lawyer fees, if he/she is a good lawyer, they will have TJ Maxx pay for all those laywer fees.
