TJ Maxx, Marshalls, HomeGoods settlement

The TJX Companies Inc. has agreed to a $8.5 million class action settlement over allegations that T.J. Maxx, HomeGoods, and Marshalls stores use misleading price tags.

Customers who purchased one or more items from a T.J. Maxx, Marshalls, or HomeGoods store in California between July 17, 2011 and Dec. 6, 2017, can file a claim to receive either a merchandise store credit or cash from this class action settlement.

The T.J. Maxx class action lawsuit, filed in July 2015, alleged T.J. Maxx’s use of the phrase “Compare At” on price tags was deceptive. Plaintiffs Staci Chester and Daniel Friedman argued that the “Compare At” prices were false and misleading about the actual price of comparable items at other stores.

The class action lawsuit says comparative pricing used at T.J. Maxx, HomeGoods, and Marshalls deceives consumers into falsely believing they are saving considerable amounts on items purchased.

While the T.J. Maxx website defined the “Compare At” price as buying staff’s estimate, the actual price tags include no such explanation. The lawsuit charged T.J. Maxx with unfair business practices, fraudulent business practices, unlawful business practices, false advertising, and with violating California’s Consumer Legal Remedies Act.

Class Members who submit a valid claim will receive a TJX Merchandise Credit. The amount of the credit will be determined by the total number of claims filed. The credit will be valid only in California stores. Claimants will have the option of exchanging an unused Merchandise Credit for cash in the amount equal to 75 percent of the credit.

TJX Companies also agreed to change pricing disclosures on its website and on signs in California stores, and to take additional measures to ensure the company complies with California’s price comparison advertising regulations.

The T.J. Maxx deceptive pricing class action settlement was granted preliminary approval on Dec. 5, 2017. Class Members have until April 9, 2018 to object or opt out of the settlement.

Who’s Eligible

All persons who purchased one more items from a T.J. Maxx, Marshalls, or HomeGoods store in California between July 17, 2011 and Dec. 6, 2017, with a TJX price tag that included a “Compare At” price, and who have not received a refund or credit for all of their purchases.

Potential Award

TJX Merchandise Credit.

Class Members who file a valid and timely claim will receive a TJX Merchandise Credit. The amount of the credit will be pro rata, based upon the money left in the $8.5 million settlement fund after court-approved fees and expenses. Unused Merchandise Credits may be returned to the settlement administrator and exchanged for cash in an amount equal to 75 percent of the credit.

    Say what you want, these stores still have great values! You gotta be smarter than the price tag and false advertisements and use common sense along with the amazing advantages of a smartphone and bar code scanning!

    California only, geez. These store are ripping off the other 49 states too. Just because we don’t drive Prius’s and hug trees doesn’t mean we don’t count. Kohls does the same thing!!!

      Unfortunately, this particular case is based upon the violation of several California consumer protection laws. These laws very from state to state. You may want to contact your state’s Attorney General’s office to inquire about consumer protection laws in your state. You can also contact class counsel with questions.     I have lived in California for over 30 years and I routinely shop at all three stores for as long as I can remember. In fact, I just bought a ton of stuff from TJ, and Home goods this Christmas. Please include me in this suit I am definitely eligible! . Thanks!

    Why are so many claims only applicable to California residents? I’m sure if it’s hsppening in the stores in California it’s happening in every other state as well.

      California has some very strict state consumer protection laws. This is why some settlements only apply to products purchased in California.

    This is just legal bunny boiling. TJX regular retail price indications are always, in my experience, less than real retail. I have no problem paying $20 for an item TJX indicates costs $39 when the real original retail price of $185 (Ralph Lauren) is also on the item. I hope TJX sees this minor lawsuit as just what it was. A little lawyerly bottom feeding. Leave TJX alone and go chase ambulances like everybody else.

      AMEN to that! Are consumers so stupid? Retail prices are dynamic and always changing, based on the stores deal for the week. I hope this doesn’t cause TJ MAXX to increase their margins and cause higher prices in the future. The only value that matters is the one you’re willing to pay.

        Unfortunately, this will probably cause prices to go us a little. How can they pay $8.5mil and not have it affect their bottom line. This wasn’t stealing money from shoppers, for crying out loud. Stop with these ridiculous lawsuits!! The only winners are the lawyers ($2,125,000) and the losers are consumers that now have higher prices to cover this.
