Neiman Marcus Fake Sale Class Action Settlement

Top Class Actions viewers are starting to receive checks from the Neiman Marcus Last Call fake sale class action settlement worth as much as $373.90.

In April, Neiman Marcus reached a $2.9 million class action settlement deal with customers who claimed that the company advertised fake “compare to” prices at their Last Call stores to convince shoppers that they were getting a better deal than they actually were.

Allegedly, the “compare to” price did not actually reflect the item’s retail value at another store, and was therefore misleading to customers.

Customers who were eligible for benefits from the Neiman Marcus Last Call class action settlement were those who purchased an item advertised with a “compare to” price at a California Neiman Marcus Last Call store or on Last Call’s website between Aug. 7, 2010 and May 21, 2018.

The deadline to file a claim for the Neiman Marcus Last Call class action settlement was Aug. 20, 2018.

The customer class was represented by Michael Louis Kelly, Behram V. Parekh, and Joshua A. Fields of Kirkland & Backard LLP.

The Neiman Marcus Last Call Class Action Lawsuit is Rubenstein v. The Neiman Marcus Group LLC, Case No. 2:14-cv-07155-SJO-JPR, in the U.S. District Court for the Central District of California.

California TJ Maxx, Marshalls, & HomeGoods Deceptive Pricing Settlement

Top Class Actions readers also report they have begun to receive gift cards worth as much as $27.53 from a TJ Maxx, Marshalls, & HomeGoods deceptive pricing settlement.

The TJX Companies Inc., owners of TJ Maxx, Marshalls, and HomeGoods, agreed to pay $8.5 million in a settlement resolving claims that their stores use misleading price tags to entice consumers into purchasing their products.

Allegedly, the stores listed “compare at” prices when advertising products, to convince consumers that they were getting a better deal on items than they would if they had shopped elsewhere.

However, customers said that the “compare at” prices did not accurately reflect the price at which the items were offered at other stores.

Customers who purchased items from one of the three stores in California between July 17, 2011 and Dec. 6, 2017 were eligible for benefits from the TJX Companies class action settlement.

The deadline to file a claim for the California TJ Maxx, Marshalls, & HomeGoods deceptive pricing settlement was April 9, 2018.

Customers were represented by Douglas Caiafa of Douglas Caiafa A. Professional Law Corporation, Christopher J. Morosoff of the Law Office of Christopher J. Morosoff, and by Greg K. Hafif of the Law Office of Herbert Hafif.

The California TJ Maxx, Marshalls, & HomeGoods Deceptive Pricing Class Action Lawsuit is Staci Chester, et al. v. The TJX Companies Inc., et al., Case No. 5:15-cv-01437, in the U.S. District Court for the Central District of California.

Aveeno Naturals Class Action Settlement

Top Class Action readers are reporting that they have started to receive settlement checks worth as much as $168 from an Aveeno Naturals class action settlement.

Johnson & Johnson reached a settlement with consumers who claimed that the company’s Aveeno Active Naturals products contain synthetic ingredients and are therefore falsely advertised as “natural.”

Customers who purchased certain Aveeno Active Naturals and/or Aveeno Baby products between May 7, 2007 and June 13, 2017 were eligible for up to $2.50 per product in the Aveeno class action settlement.

The deadline to file a claim for the Aveeno Naturals Class Action Settlement was Feb. 4, 2018.

Class Members were represented by Todd S. Garber of Finkelstein Blankinship Frei-Pearson & Garber LLP, and by Kim E. Richman of Richman Law Group.

The Aveeno Naturals Class Action Lawsuit is Goldemberg v. Johnson & Johnson Consumer Companies Inc., Case No. 7:13-cv-03073-NSR-LMS, in the U.S. District Court for the Southern District of New York.
