Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.

The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.

BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.

Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.

Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.

Who’s Eligible

Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.

The following vehicles are covered by this settlement:

  • 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
  • 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
  • 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
  • 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
  • 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
  • 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
  • X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
  • X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
  • X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award

Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.

Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:

  • Three free future oil services, up to $75 per service.
  • Free engine replacement.
  • Reimbursement of past oil services, up to $75.
  • Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
  • Reimbursement for the cost of a replacement battery that was less than 3 years old.
  • Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase

If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

    I have 2012 750Li
    I bought it 2016 and I need to add oil every 2000 miles my technician told me it is normal for 750Li
    I think the auxualy pump issue cause the engine hot and create all the problem . Now I have to add 2 lite of oil every 1000 miles. I have same issue if you let you car idle for two minutes excessive smoke come out. I took my car to dealer they told me oil leakage issue they cannot do oil consumption test. I won’t be able to qualify for the engine replacement program because you have to have two failed in the test.
    What Can I do.

      Yes my car is 2011 bmw 550i gt I keep using all every 300 miles how do I get the test

    I have a 2011 bmw 550 and it’s burning oil and smoking theses motors have a serious problem and bmw knows we pay a lot of money for these vehicles and they should stand behind theses cars and fix them

    I have a 2011 X6 same oil issue even after engine was rebuilt. Good luck the problem will never go away. Warranty is a joke all they do is put a bandaid on it until it expires. If I can get reimbursed for repairs and trade it to someone other than BMW I’m good. Over it!!!

    Hi, i have a 2008 750li with all the same issues and cant count how much oil ive added pluse replaced battery and now car wont start cant hear anything lights on probably the engine.. How can i be included… Not fair

    Wow, I am so comforted now knowing I’m not alone!! Purchased my car Aug 2016 with 55k miles. I hadnt had the car a month and called the dealership freaking out because the oil light came on and I didnt want to kill the engine! Needless to say not knowing at the time this would be a routine occurrence, i drove all the way to the dealership for them to top my oil off. Now Aug 2018 with only 78k miles. Needs Oil about every 2 weeks or less. an oil pan gasket job needed costing 1000s, Car smokes when sitting…..I thought I purchased a lemon. But seems this is what all 2012 750i model owners are experiencing. I do have a question about this Class Action Suit. I can’t even count the amount of 5qts of Castrol oil I’ve purchased and keep in the car. I have no receipts and if I did why would the VIN# be on it? How can I request reimbursement for that. And second…. why is the upto $1500 not eligible to be used for repairs. $1500 towards a NEW BMW especially a 750 is nearly nothing! If BMW cars and stands behind the brand help existing owners manage and seemingly manageable issue!

    I Have a BMW 750i also ever 300 to 500 miles. The min oil computer said add a quart oil so that’s what I do so I don’t have a big problem. I be so scared of that oil consumption can’t even travel an have good time . 2009

    I’m sick and tired of being sick and tired of this BMW issue. I was told by the dealership, that because I have a twin turbo its normal in my 550i that I need to add oil every 200 miles. I also had an engine that was replaced, but now I have problems with the coolant leaking, new engine overheating. Hoses been replaced for a whoppin $800.00!
    Please help with the cost repairs BMW! Its a shame that the ultimate driving machine is letting us consumers down.

    I have a 2012 BMW 750i and took it to my BMW retail Service Center and explained to them the car was smoking and ask them why do I half to put oil in my bmw every 150-300 miles as well. They explained to me it was related to this claim so I am waiting for this Class actions to settle to see what their going to do about it.

    I have a 2011 BMW 750 Li with 78,000 Miles. My oil light comes on about every 200-300 miles. And my car smokes. I took my car to the BMW dealer and the service advisor stated that I need a valve seal job…….are you kidding me. The cost is between 9Ks-12Ks. I purchased the car 4 years ago with 34,000 Miles and it was a CPO from the BMW dealer…..I have 2 years left to pay this car off, I’m not trying to have a car payment and maintenance bill at the same time. BMW have really disappointed me. I have a Ford truck with 247Ks and it never smoked or anything. And it’s 21 years old.

      Yes my car has the same problem it is in the shop now I have 2011 BMW 550I GT they told me today gasket leak this car they keep topping the oil off every 200 miles

      I have a 2011 750Li as well, about the same miles and same exact issues. Nothing like your car smoking after sitting idle for 5 minutes or more. I was quoted $8K for the repair. I literally carry 2 quarts of oil in my trunk “just in case” and have a box of oil from Costco sitting in the garage. Is it me or does that minimum oil light go off at all the wrong times! Wondering what the maximum benefits are that we can get from this Class Action Lawsuit, and how fast.

    I need a client ID Number. I did not receive a packet. I have a 2011 750i BMW and I was complaining to my shop about the oil consumption. So yes I know I qualify and I have all of my service records.
