Consumers who purchased Behr DeckOver may be able to benefit from a class action settlement over allegations that the product deteriorates faster than advertised.

Under the terms of the Behr DeckOver Resurfacer class action settlement, consumers who bought/used the product between Sept. 1, 2012 and June 27, 2018 may be able to file a claim for a refund and for reimbursement for removal and/or repair of their deck. The product was exclusively sold at Home Depot for approximately $35 a gallon.

The Behr DeckOver Resurfacer class action settlement puts to rest allegations that the product, marketed at a premium to comparable stains, deteriorated on consumers within months of application.

The class action lawsuit claimed that consumers paid more for Behr DeckOver stain based on advertising that its thicker coating would last longer and require less upkeep than other deck staining products.

Although Behr admits no wrongdoing under the terms of the Behr DeckOver Resurfacer class action settlement, it has agreed to pay Class Members who can provide supporting documentation both a refund for the gallons of the DeckOver product used and for any repairs necessary.

The deadline to submit a claim for a refund and/or reimbursement for repairs is Feb. 27, 2019.

Class Members who wish to object to or exclude themselves from the Behr DeckOver Resurfacer class action settlement have until Oct. 15, 2018.

Who’s Eligible

Class Members include individuals nationwide who purchased DeckOver between Sept. 1, 2012 and June 27, 2018.

Potential Award

Varies depending on the amount of Behr DeckOver product purchased during the class period and cost of any repairs.

Proof of purchase and supporting documentation for any repairs.

UPDATE: According to the settlement website, the administrator discovered that some potential class members did not receive direct notice of the Behr class action settlement. These subclass members have been given an updated claim deadline.

    I keep checking on this page to see if anyone has gotten checks (besides the lawyers). This is ridiculous. If the settlement has been approved then just give us the money we are entitled too. This horrible product ruined our deck. It is actually speeding up the rotting process I think. Is there any contact info that works? Maybe we need a class action suit against the lawyers who are handling this .

    I didn’t know there was a class act again that garbage I spent over $300 on .. how about the time that was put in painting the deck .. and my sect is huge . I have all the receipts .. I went to homedepot to look for stain and I was told about the class act how people got their money back .. shame on Home Depot for not advising the customers who bought this garbage .

        A boycott of all Behr products needs to happen. I know it probable won’t. But this company should be made to take responsibility. Is there any federal govt branch that could get
        involved, I feel i’m s–t out of luck and been f—ed by Behr.

    I just learned of the lawsuit against Behr. This is May 2021!
    Is there another class action started for those of us that were never contacted? We spent allot and have to replace the deck. What a miserable mess and costly waste of time.

      I am in the same boat. I don’t understand why if there was a class action lawsuit of this magnitude this destructive product wasn’t pulled from the shelves. I have to replace half of my deck which was in fine condition two years ago when I applied this product. Now my deck has rotted away like it’s infected or diseased. I’ve never seen anything like this. It may be time to start a new class action suit since apparently nothing has been done to correct the product’s destructive nature and it remains readily available for purchase by the unknowing consumer.

      I’m in the same position as you are. I recently found out this week 6/3/2021, that my deck needs to be replaced because of the Behr Deckover stain was used a few years ago to stain my deck. My deck is completely destroyed. I’m totally upset and confused & at a total lost as to what steps I can take to rectify this problem. I guess I can file a complaint with my local attorney general office.

      Been waiting 2 years. Past correspondence said I will receive a check within months. Now no one responds to my inquiries. Not sure what steps to try next. I’m willing to take any reasonable settlement since mine was large with all the damaged decks I have. Very disappointed.

      Me either!!! They said my claim was being audited over a year ago. I need the money to repair my deck! It is dangerous at this point and I am a single mother with kids here! They do not give updates or return calls. It feel like they are just ripping us all off all over again. I hope everyone on here never shops at Home Depot again. It’s the only thing we can do ! They do not care about doing what’s right for their customers!!

    I was told via email on January 4th 2021 that I was in the next batch of checks… 3 months later — nothing… they will not even respond to the inquiries. THEY gave me the information — so I dont understand why I have not received the money.

      Just found out about this class action suit. Was never notified. Deck is peeling and rotting, the edge of one stair has rotted off, very dangerous as we are elderly.

      No. Read that they have a status update to court to give the court info on payments sent out and the court asked it be complete by Feb 23 or feb 10 cant remember which date.

      Good Afternoon:
      My name is Danny, I was approved for my settlement and just by luck I decided to contact the administrator and my check was issued on January 8, 2021 but they sent my check to my old address after updating my address a year ago. I was told today they do not know why the administrator that cut the checks did not update their system, which proves to me they are not auditing the claims because if they did they would have seen that I made sure with a confirmation email that my address was changed. So now I have to wait for the company to contact me before they could stop payment on the previous check to reissue another check…
