Consumers who purchased Behr DeckOver may be able to benefit from a class action settlement over allegations that the product deteriorates faster than advertised.

Under the terms of the Behr DeckOver Resurfacer class action settlement, consumers who bought/used the product between Sept. 1, 2012 and June 27, 2018 may be able to file a claim for a refund and for reimbursement for removal and/or repair of their deck. The product was exclusively sold at Home Depot for approximately $35 a gallon.

The Behr DeckOver Resurfacer class action settlement puts to rest allegations that the product, marketed at a premium to comparable stains, deteriorated on consumers within months of application.

The class action lawsuit claimed that consumers paid more for Behr DeckOver stain based on advertising that its thicker coating would last longer and require less upkeep than other deck staining products.

Although Behr admits no wrongdoing under the terms of the Behr DeckOver Resurfacer class action settlement, it has agreed to pay Class Members who can provide supporting documentation both a refund for the gallons of the DeckOver product used and for any repairs necessary.

The deadline to submit a claim for a refund and/or reimbursement for repairs is Feb. 27, 2019.

Class Members who wish to object to or exclude themselves from the Behr DeckOver Resurfacer class action settlement have until Oct. 15, 2018.

Who’s Eligible

Class Members include individuals nationwide who purchased DeckOver between Sept. 1, 2012 and June 27, 2018.

Potential Award

Varies depending on the amount of Behr DeckOver product purchased during the class period and cost of any repairs.

Proof of purchase and supporting documentation for any repairs.

UPDATE: According to the settlement website, the administrator discovered that some potential class members did not receive direct notice of the Behr class action settlement. These subclass members have been given an updated claim deadline.

UPDATE 2: On April 9, 2020, Top Class Actions viewers started receiving checks in the mail from the Behr DeckOver class action settlement worth as much as $3,060. Congratulations to everyone who filed a claim and got PAID!

    i had my deck resurfaced, I paid a pretty penny too,they used Deck-over, it was beautiful in the beginning but now in less than a year the paint has started tocome off in places, is there a recourse for me?

    We used this last year on our deck. It is a mess. We just purchased more to redo without knowing about lawsuit. Shame on us and shame on them for selling it to us. I called customer service they referred me to law suit. The dates would not help us.

    We painted our 38 ft, x 40 ft deck each year from 2014 thur 2018 with gal. can’s of behr deckover paint because we wanted the best pertection for the wood deck boards around our swimming pool. But each year the print coats would just pill up in large sections, leaving our deck board opposed to the weather, due to this, the top grade deck boards have mostly rotted, along with a lot of the high price deck screws also rusted off in the wood. We may be able to find some receipts, but we still have some of the paint can’s, as well as some photo’s of the paint peeling off, it has left us with a real mess and a lot of wasted time, hard work and money, All of which needs to be redone, So much for buying the best.

    I called Behr directly & complained about deckover in 2016. To make a long story short,they offered me $400.00 & had me sign a waiver for any other damages. The guy said that was all they would do. They wouldn’t pay for any work to sand off the old, peeling, deckover & replace with something better. This was three decks we put this crap on. I figured I got screwed over on this!! Can’t believe they still showing commercials & selling this stuff!
