Consumers who purchased Behr DeckOver may be able to benefit from a class action settlement over allegations that the product deteriorates faster than advertised.

Under the terms of the Behr DeckOver Resurfacer class action settlement, consumers who bought/used the product between Sept. 1, 2012 and June 27, 2018 may be able to file a claim for a refund and for reimbursement for removal and/or repair of their deck. The product was exclusively sold at Home Depot for approximately $35 a gallon.

The Behr DeckOver Resurfacer class action settlement puts to rest allegations that the product, marketed at a premium to comparable stains, deteriorated on consumers within months of application.

The class action lawsuit claimed that consumers paid more for Behr DeckOver stain based on advertising that its thicker coating would last longer and require less upkeep than other deck staining products.

Although Behr admits no wrongdoing under the terms of the Behr DeckOver Resurfacer class action settlement, it has agreed to pay Class Members who can provide supporting documentation both a refund for the gallons of the DeckOver product used and for any repairs necessary.

The deadline to submit a claim for a refund and/or reimbursement for repairs is Feb. 27, 2019.

Class Members who wish to object to or exclude themselves from the Behr DeckOver Resurfacer class action settlement have until Oct. 15, 2018.

Who’s Eligible

Class Members include individuals nationwide who purchased DeckOver between Sept. 1, 2012 and June 27, 2018.

Potential Award

Varies depending on the amount of Behr DeckOver product purchased during the class period and cost of any repairs.

Proof of purchase and supporting documentation for any repairs.

UPDATE: According to the settlement website, the administrator discovered that some potential class members did not receive direct notice of the Behr class action settlement. These subclass members have been given an updated claim deadline.

    I submitted a form for the subclass portion on 1/11/2020 and I still haven’t heard a word. I just sent an email asking for an update and received the response below. At this point what is the “small guy” suppose to do against a giant corporation like this?

      Most of us submitted in 2018. There’s nothing we can do. It’s possible judges may not be happy it’s taking this long to distribute thought but they exercised their right to review each case individually

    Informed delivery shows deckover settlement today! Did you guys get what you were supposed to? About time!! I’ll update. I was approved for 3000 sf and 40 gallons..although the square footage should of been more just grateful for anything its been so long. Just hoping this is finally it!

        This better be it!! I saw a couple post they received checks recently (last week) but never posted how much. Someone on fb said they received a denial last month too but idk how..they either tried claiming the sub class and didn’t belong or thinking of a different settlement. Denials went out years ago from what i remember. I received an email saying what I was approved for in oct of 2019 and last thing i inquired about a month and a half ago and they said the checks would go out on rolling basis they were in audit stage of completed claims and if they needed anything they would email again.

          They sent me $1600 wayyyy off..thats a huge insult especially when we already agreed upon something. Smh. Another woman on fb received a check for $400. If this is reimbursement for product only that makes sense but for damages and product, this is thoisands off!

      I also got a call today about a deck we did 2 years ago, did all the right procedures recommended by the lady at home depot selling the behr products. Used the behr paint stripper, then behr conditioner before applying 2 heavy coats and leaving proper amount of time in between dry time. The customer called me upset accusing me of doing it wrong because the paint is peeling off in big pieces along the deck. This really does not look good on me as a contractor and I’m not sure why this product is still on the market! Very upset and discouraged

    Has anyone received payment yet? I received a notice from them about eight months ago saying our settlement had been approved. They said they were working through the process. But still no payment. Why do I feel like I’ve been scammed?

    we had no idea this class action was going. we bought this paint in 2018. many areas of our deck peeled. we repainted in 2019. now again in 2020 deck looks horrible. guess by all of your comments it wouldn’t have done us any good to complain. very sad they won’t stand behind their product.

        Pursuant to the Settlement Agreement the Parties are performing an audit of all complete claims. The claim audit review process remains ongoing. Review of the documentation required to make a sufficient claim in this matter is complicated, and the review process may take additional time.

        We do not know how long it will take before your claim completes the audit process. Once the processing and review of your claim is complete, additional documentation may be requested.

        If your claim is approved by the Parties without any additional requested information, payments will be mailed out on a rolling basis.

        Please do not contact the parties. The parties are not permitted to address any issue with you directly and will advise you to contact the Settlement Administrator. Contacting the parties will slow the process.

    I just found out about the class action.coated my deck in 2015 and it peeled less than a year later. I recoated the peeling areas but it peeled again.Now it’s peeling everywhere. Can I get my money back or am I too late?It seems like no one is getting paid.Whats going on?

    To file a claim. My name appears in the settlement agreement and I received a letter that stated my claim was approved.
    I have not received payment. This case is going on almost three years with no payment for damages.
    What an upsetting development. These lawyers are getting 1.5 M dollars to work on this case. What’s going on?

      I am the same as you. A named party in the case. I received an email that stated my claim was complete and approved. I was considering contacting an attorney to see if delay of payment can be taken to court. It seems that very few people have received their payment and ones that have don’t get what they expected. Seems like some serious stall tactics.

    Not unlike the comments you have received regarding your concrete paint, I made a claim a couple of years ago. I received a phone call and a postcard stating that they were working on my claim. Since then……nothing!

    I filed a claim for my parents and they never received any compensation for their loss.
    The money and hours they spent in refinishing the deck around the pool was tremendous.
    Unfortunately they had high credit card bill at home depot to pay.
    Sadly no compensation and they are still waiting.
