Consumers who purchased Behr DeckOver may be able to benefit from a class action settlement over allegations that the product deteriorates faster than advertised.

Under the terms of the Behr DeckOver Resurfacer class action settlement, consumers who bought/used the product between Sept. 1, 2012 and June 27, 2018 may be able to file a claim for a refund and for reimbursement for removal and/or repair of their deck. The product was exclusively sold at Home Depot for approximately $35 a gallon.

The Behr DeckOver Resurfacer class action settlement puts to rest allegations that the product, marketed at a premium to comparable stains, deteriorated on consumers within months of application.

The class action lawsuit claimed that consumers paid more for Behr DeckOver stain based on advertising that its thicker coating would last longer and require less upkeep than other deck staining products.

Although Behr admits no wrongdoing under the terms of the Behr DeckOver Resurfacer class action settlement, it has agreed to pay Class Members who can provide supporting documentation both a refund for the gallons of the DeckOver product used and for any repairs necessary.

The deadline to submit a claim for a refund and/or reimbursement for repairs is Feb. 27, 2019.

Class Members who wish to object to or exclude themselves from the Behr DeckOver Resurfacer class action settlement have until Oct. 15, 2018.

Who’s Eligible

Class Members include individuals nationwide who purchased DeckOver between Sept. 1, 2012 and June 27, 2018.

Potential Award

Varies depending on the amount of Behr DeckOver product purchased during the class period and cost of any repairs.

Proof of purchase and supporting documentation for any repairs.

UPDATE: According to the settlement website, the administrator discovered that some potential class members did not receive direct notice of the Behr class action settlement. These subclass members have been given an updated claim deadline.

    I submitted my claim on 10/25/18. Since, I have not heard a word on my claim. I do know you have received it by tracking this mail but you have never verified it’s arrival! I would be more patient if I at least knew it was in the mix to be reviewed!

    I also just learned about these issues. I have had to replace some boards and need more replaced. I do not recommend deckover now because of these issues.

    I just found out about this today. The same thing happened to my Deck. The paint cracked the first year, then started peeling and anyplace the pain t remains rotted

    Pursuant to the Settlement Agreement the Parties are performing an audit of all complete claims. The claim audit review process remains ongoing. Review of the documentation required to make a sufficient claim in this matter is complicated, and the review process may take additional time.

    We do not know how long it will take before your claim completes the audit process. Once the processing and review of your claim is complete, additional documentation may be requested.

    If your claim is approved by the Parties without any additional requested information, payments will be mailed out on a rolling basis.

      Slow the process? I have a condemned deck needing total replacement. My claim was verified and accepted 18 months ago. I want to sell my house but can not with the safety issue surrounding my deck.

      I have not heard a thing about my claim…
      We have thousands invested in the paint, the work and a new patio because the Behr paint peeling off and our deck ROTTED!
      Why have other people gotten letters and at least told they are approved???
      We need that check…
      We are not rich or even close to being rich. We need that check to cover the costs we have incurred. Please help me and my husband.

    I purchased Behr Deckover it started peeling. So I contacted Behr and sent pictures and proof of purchase, they sent me more cleaner and Deckover stain free. They said I much have applied the Deckover incorrectly They didn’t said anything about the lawsuit or about all the problems everyone else is having. Now I am having to replace boards that are rotten. Is there anything I can do at this point to get reimbursed for all boards I’m having to replace?

      I have not received my check and every time I contacted the administrator it was an issue, first they claimed I missed the deadline and I sent them proof via email that I filed in a timely manner, secondly they claimed I missed the deadline to send in proof of use of the item, I informed them that I never received any correspondence from the administrator and the nasty disrespectful young ladies who answer the phone, who are clueless and last I was informed they could use the open unused can of Deckover Stain. It was as if they want us to give up on the claim after they’ve made all the money. On June 3, 2020 I finally received a email indicating that my claim was complete and the auditor are going over all complete claims.
      This is ridiculous too me and possibly other claimants.

      We haven’t received any compensation either. It’s over 2 years now. This is ridiculous.

        We have not received any compensation. We did receive an email 7/3/2020 stating our claim was complete. We have been tied up with this since 5/2015. Of course I’m sure they will claim Covid 19 has complicated matters..having a rotted deck has complicated our lives!
        Just a simple resolve…SEND COMPENSATION!

    I just now was contacting bear in Home Depot wanting to know what the deal is on this deck over Paint That was supposed to protect my deck. It is completely I wrecked now that the paint peeled and cracked and moisture apparently stayed in the wood and rotted it. My girlfriend walked over to the edge and her foot went completely through the edge of a board and did serious damage to her leg. I took pictures as I started to tear the boards up and you can see how it just rotted from inside to out. Terrible product and I think I should be compensated like everyone else has been. I bought 9 gallons of this mess and it ruined my whole deck. I’m having to come out of pocket on new material and also a lot of time that it has cost me. To whom it may concern
