A settlement has been reached in a class action lawsuit alleging AT&T used an automatic telephone dialing system and/or an artificial or prerecorded voice to contact consumers on their cell phones about AT&T’s U-verse service without first obtaining the prior express consent of the cell phone service subscriber.
If you received a communication from AT&T regarding a U-verse account for which you were not the accountholder, you may be entitled to benefits from the AT&T class action settlement.
Plaintiff Kison Patel initially filed the AT&T class action lawsuit in September 2015, accusing the company of using a predictive dialer and leaving a prerecorded voice message in violation of the Telephone Consumer Protection Act.
Patel says he received a call on his cell phone from AT&T, and when he answered the call, he heard a prerecorded message regarding an account. According to the AT&T class action lawsuit, Patel did not give AT&T permission to contact him on his cell phone about the account, and the call was allegedly not made for emergency purposes. He asserts the phone calls made by AT&T violated the TCPA.
Companies that make calls in violation of the TCPA may be subject to statutory penalties of $500 per violation or $1,500 per willful violation of the TCPA.
AT&T denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the cost, risk and uncertainty associated with ongoing litigation. The company will pay nearly $2 million to settle the TCPA class action lawsuit.
The AT&T class action settlement was preliminarily approved on Oct. 11, 2016.
Who’s Eligible
Class Members of the AT&T settlement include: “All subscribers to those wireless telephone numbers identified as having lodged a complaint prior to November 18, 2015, regarding receiving a communication from AT&T regarding an AT&T U-Verse account for which they were not the accountholder (excluding subscribers of AT&T wireless and/or U-verse services).”
Potential Award
Up to $250.
The actual amount each Class Member receives will depend on the total number of claims filed. Each claimant will be entitled to a base payment of a pro rata share of the settlement fund, up to $250 per claimant. If there is money left over in the settlement fund, the remaining funds will be distributed on a pro rata basis based on the number of automated calls made to the cell phone number, up to $500 per call.

I also got an email saying that my claim was valid and would be getting a check. I’m in NY and have got nothing.
I am so disappointed because u can’t reach anyone to ask questions !! Although I was told my claim was valid I haven’t received any payment!! So does anyone have a update or any knowledge of the process ? I also did receive an W-9 form that I reading about !!
I think it’s safe to say no we are not receiving a check.if so we would have definetlt received it by now
Hello has anyone who filed thru topclass in va or near va received a check as of yet..I’ve only heard of about 3 people so far whom have claimed to receive a check..which is on facebook and here ..I’m guessing since it’s Dec,13 i won’t be receiving anything ?

I received my check yesterday, 12/11/17 in the amount of $570.75. It was a very nice surprise.

I’m lead to believe this whole settlement is a scam.I filed my claim online and gotten confirmation.A month later when I called ‘Mr.Curtis’ said I had a Valid claim but because a lot of of companies were also trying to scam other claimants,it would be a hold on checks.Two weeks later I called again for him to tell me I wasn’t apart of it and my claim wasn’t valid.Today I received a w-9 form and was also told by him again today that my claim is valid and that perhaps it was a mishap! The bullshit just doesn’t add up
I was told the same exact thing that my claim was valid until they found out I filed a claim on Top Class Action’s website then my claim suddenly became not valid !!
Can everyone stop with the nonsense that because you filed thru here your claim got denied. I filed here and received a W-9 to send back. So whats the excuse now. There were something like only 1100 valid claims, amazing so many people on here who post on numerous other settlement pages also constantly think there entitled to something here.

Hi John…..Did you try to file your W9 online thru the website. Keeps giving a database error to me. Waiting on replies from settlement admin and lawyer.

The voice mail does not state that class members that filed through TopClassActions.com will not get paid. It states that your claim MAY NOT be valid IF you read about the settlement on TopClassActions.com or another class action website because there was a specific class member list provided by AT&T. VALID CLAIMS filed through Top Class Actions should be paid. The message also states that checks under $600 were mailed on 12/5/17.
