AT&T Express DSL Speed Class Action Settlement

AT&TAT&T has reached a class action lawsuit settlement with Express DSL customers in Missouri, Kansas, Oklahoma, Arkansas and Texas that will provide $8.00 for each month their DSL service was slower than promised.

The AT&T DSL speed settlement will resolve a class action lawsuit, entitled Schmidt v. AT&T and SBC Internet Services, Inc., that alleges AT&T (formerly SBC) failed to deliver DSL service to its customers at the speed promised. Specifically, the class action lawsuit alleged that AT&T and/or SBC breached its contracts with and defrauded some of its customers by capping the DSL internet speed that some of its customers could obtain below the maximum promised speed for the plan the customer purchased.  The class action lawsuit also alleged that AT&T and/or SBC breached its contract with and defrauded some of its customers by delivering speeds lower than the minimum promised speed under the customer’s plan.

AT&T denies the allegations but has agreed to a class action lawsuit settlement to avoid ongoing litigation.

Class Members of the AT&T Express DSL class action settlement include current and former AT&T/SBC customers who had DSL service of 384 kbps up to 1.5 Mbps (commonly known as the “Express” plan) in the states of Missouri, Texas, Oklahoma, Kansas or Arkansas, and whose lines were capped (or set) at speeds below 1.5 Mbps, including 384 kbps and 768 kbps, or who were not provided speeds of at least 384 kbps within one or more months during the class period.

 
AT&T customers in any other state can also file a claim under the class action settlement, but for a different amount. See “AT&T DSL Speed Class Action Settlement” for more information.
 
Some Class Members may have already submitted claim forms for this settlement, but the settlement benefits have been increased to $8.00 for each month their service was affected. As a result, Class Members who previously submitted a claim form do not need to do anything to receive the increased benefits.

If you did not previously submit a claim form, you can submit one now. Claim forms must be submitted online at www.ExpressDSLSpeedSettlement.com or postmarked by May 31, 2012.

If you previously opted out of the AT&T Express DSL settlement, you are not eligible to receive the increased benefits unless you withdraw your opt-out request. You can do this by submitting a claim form by the deadline of May 31, 2012.
