AT&T data throttling

AT&T Services Inc. has agreed to pay $2.75 million to settle a class action lawsuit alleging it misclassified designers and deliverers as exempt from federal and California state overtime pay requirements.

If you worked at AT&T as a Senior Training Manager Design or Senior Training Manager Delivery, you may be entitled to compensation from the AT&T unpaid overtime class action settlement.

The plaintiffs allege AT&T violated the federal Fair Labor Standards Act and California labor laws by misclassifying them as independent contractors instead of employees. The FLSA is a federal law that ensures U.S. workers are paid fairly for all hours worked, including overtime pay for non-exempt employees who work more than 40 hours in a workweek. California labor law also provides additional protections for workers in the state.

“AT&T has unlawfully classified Plaintiffs and Training Specialists as exempt from overtime payments under federal and state laws, despite the fact they should have been classified as non-exempt,” the AT&T unpaid overtime class action lawsuit states. “Plaintiffs and Training Specialists worked overtime hours, as defined by the applicable federal and state laws, and are and have been entitled to compensation at the appropriate rate … for all overtime hours worked.”

AT&T denies any wrongdoing and maintains that it complied at all times with applicable federal and California overtime laws. However, it has agreed to pay up to $2.75 million to settle the unpaid overtime class action lawsuit and avoid the cost, delay and uncertainty of ongoing litigation.

The AT&T unpaid overtime class action settlement was preliminarily approved on Oct. 16, 2017.

Class Members who would like to exclude themselves from or object to the AT&T unpaid overtime settlement must do so no later than Dec. 28, 2017.

Who’s Eligible

Class Members of the AT&T unpaid overtime settlement include anyone who worked for AT&T Services Inc. or AT&T Mobility Services LLC as a Senior Training Manager Design or Senior Training Manager Delivery and who are not bound by the Management Arbitration Agreement during any of the following applicable time periods:

  • From May 18, 2011 to Oct. 16, 2017 for California-based employees;
  • From May 18, 2012 to Oct. 16, 2017 for non-California employees who opted into the AT&T unpaid overtime lawsuit; and
  • From Aug. 18, 2014 to Oct. 16, 2017 for non-California employees who did not opt into the AT&T unpaid overtime class action lawsuit.

Varies.

The settlement amount that each Class Member will receive depends on a number of factors including whether they worked within the state of California or outside of California, as well as the number of weeks worked during the Class period.
