A settlement has been reached in a class action lawsuit alleging AT&T used an automatic telephone dialing system and/or an artificial or prerecorded voice to contact consumers on their cell phones about AT&T’s U-verse service without first obtaining the prior express consent of the cell phone service subscriber.
If you received a communication from AT&T regarding a U-verse account for which you were not the accountholder, you may be entitled to benefits from the AT&T class action settlement.
Plaintiff Kison Patel initially filed the AT&T class action lawsuit in September 2015, accusing the company of using a predictive dialer and leaving a prerecorded voice message in violation of the Telephone Consumer Protection Act.
Patel says he received a call on his cell phone from AT&T, and when he answered the call, he heard a prerecorded message regarding an account. According to the AT&T class action lawsuit, Patel did not give AT&T permission to contact him on his cell phone about the account, and the call was allegedly not made for emergency purposes. He asserts the phone calls made by AT&T violated the TCPA.
Companies that make calls in violation of the TCPA may be subject to statutory penalties of $500 per violation or $1,500 per willful violation of the TCPA.
AT&T denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the cost, risk and uncertainty associated with ongoing litigation. The company will pay nearly $2 million to settle the TCPA class action lawsuit.
The AT&T class action settlement was preliminarily approved on Oct. 11, 2016.
Who’s Eligible
Class Members of the AT&T settlement include: “All subscribers to those wireless telephone numbers identified as having lodged a complaint prior to November 18, 2015, regarding receiving a communication from AT&T regarding an AT&T U-Verse account for which they were not the accountholder (excluding subscribers of AT&T wireless and/or U-verse services).”
Potential Award
Up to $250.
The actual amount each Class Member receives will depend on the total number of claims filed. Each claimant will be entitled to a base payment of a pro rata share of the settlement fund, up to $250 per claimant. If there is money left over in the settlement fund, the remaining funds will be distributed on a pro rata basis based on the number of automated calls made to the cell phone number, up to $500 per call.

I just got a reply by email saying if you had a valid claim you will receive a check by the beginning of December. Due to problems the checks won’t be sent out till November 29th.

I called the (847)701-5290 and I was told by a very irate gentleman that whomever filed a claim through the T( Top) C( Class) A( Action) website will not be getting a settlement. Now I’m not understanding especially if you have a ” valid ” claim but to God be the glory. If it’s for you no matter what you will receive it if not God has more in store for you and God bless the law firm. Checks are supposed to be mailed out on Monday November 13, 2017 if you don’t get a check by Wednesday November 15, 2017 whether your claim is valid or not it’s a wrap that means your share of the money was given to what this law firm is considered to be a person with a ” valid” claim( someone that didn’t file a claim through Top Class Action). Going forward I would reconsider filing claims through Top Class Action because a lot of firms will be using this against claimants.

Called 847-701-5290 just now. The voice message states checks will be mailed out November 13th, but no checks will be issued to people who filed a claim through Top class. Stated that defendant has the names and numbers of valid claimants.

I was told my this man that answer from number above checks will be mailed 11/07/17,now he says 11/13/17.he also stated if you didn’t recvd post card,your claim will be rejected,which does not mean you are not apart of the settlement,if you didn’t recd post card.they are angry because top class actions let people know about money that you are entitle to,but don’t know about it,i smell a dead rat in the laywer office.also I recvd an email from the admin. office,confirming that my claim is valvid.we will see how this will turn out in the end.this is messed up yall.

I also contacted them with my claim# and received a message replying i can confirm that you do have a valid claim on file .we do not currently have distribution dates or amounts at this time .we are however preparing the distributions all updates will be posted on line

The information for this settlement continues to change in the information you just provided is TRUE!!!! When I called the number 847-701-5290 which hads changed over the past few days….soooo misleading for a lot of people’s who submitted a claim vs Top Class in received email confirmation might not be getting a check due to them having there own contact list!!!!!
