Details: The Ameriquest mortgage class action lawsuit settlement includes all who originated their mortgage through Ameriquest or one of the other companies listed above. It’s important to note that even though your mortgage may not be currently services by Ameriquest, if it originated through them you may be eligible to submit a claim. In addition, the Ameriquest mortgage class action lawsuit settlement combines more than a dozen individual cases into one large settlement. If your mortgage loan with Ameriquest originated after December 14th, 2001 you’re likely included in the Ameriquest mortgage class action lawsuit settlement. The five classes included in this settlement are:

 

CLASS ONE: TILA RESCISSION CLASS

 

The TILA Rescission Class is a nationwide class of borrowers who at any time on or after February 8, 2003, (or, for residents of Massachusetts, at any time on or after February 8, 2002) have actually requested rescission in writing of their loans pursuant to applicable provisions of the Truth in Lending Act or state disclosure laws on or before December 1, 2009.

 

CLASS TWO: BAIT AND SWITCH CLASS

 

The Bait and Switch Class is a nationwide class of borrowers who meet one or more of the following criteria:

(i) loan records establish a final disclosed annual percentage rate that is at least 0.9% higher (as calculated pursuant to TILA) than the disclosed annual percentage rate (calculated pursuant to TILA) contained in preclosing written disclosures made to the borrower;
(ii) loan records establish that the borrower received a loan containing a prepayment penalty, but preclosing written disclosures made to the borrower described a loan without a prepayment penalty; or
(iii) loan records establish that the borrower received a loan containing a variable rate, but preclosing written disclosures made to the borrower described a loan containing a fixed rate.

 

CLASS THREE: DISCOUNT POINTS CLASS

 

The Discount Points Class is a nationwide class of borrowers who either entered into loans (i) made after December 14, 2001, and before February 3, 2003, on which they had to pay discount points in any amount; or (ii) made on or after February 3, 2003 on which they had to pay at least three discount points.

CLASS FOUR: WHOLESALE BORROWER CLASS

 

The Wholesale Borrower Class is a nationwide class of borrowers who paid an amount constituting more than 3% of their funded loan amount in settlement charges to Ameriquest or a mortgage broker.

CLASS FIVE: LOAN SERVICING CLASS

 

The Loan Servicing Class is a nationwide class of borrowers who paid Ameriquest default and delinquency fees or costs in an amount in excess of a total of $1,000. These fees and costs include fees listed in Ameriquest’s records as late fees, legal fees, phone pay non sufficient fund (NSF) fees, bad check non sufficient fund (NSF) fees, appraisal fees, inspection fees, and recoverable corporate advance fees.

 

Most people whose mortgage was originated by Ameriquest after December 14th, 2001 will fit into one of the classes above.     Ameriquest Mortgage Class Action Lawsuit Settlement
    They changed my 30 year loan to a 40 year loan and they changed my fixed rate to an ARM without me ever knowing!! I found out when I applied for a loan modification… and all I get is $50!!! I wonder how much the Judge (Marvin E. Aspen) was paidoff for this fraud? How is this Justice?
    I’m in Cleveland, OH, anyone report to the Ohio news on this?

    I received $189.99 last week. The loan was absorbed/bought/serviced by three of the companies listed in the lawsuit.
    While the amount seems low, and eventually I was approved for a Grade A loan by another lender, am in disbelief over all of this.

    Just got my chk dated 10/15/10 and I live in Maryland. It’s a whopping $48.34! I guess I should be grateful because I got fired 20 weeks ago and still no unemployment benefits. So much for doing what you’re supposed to do as a working class citizen.

    [img][/img]We got a check for $48.34. I could not believe it! We were lucky because we did not lose our home but getting the loan was very costly so needless to say we did not make anything when we sold it. I have read everything on the mdl settlement page and according to that we should have gotten around 2900.00 they said it would be based on 60 months. So my thought is $48.34 X 60= $2900.40. but that is just wishfull thinking. they also stated that the settlement was like 695 million so if you divide that by :-[the 170,000 they said had filed claims that would be a lot more than 48.34 How come we keep getting the shaft, was hoping for the money to pay medical deductables since not cost of living increase for us seniors

    So, my wife and I just received our $52 check! These folks sold me a fixed 30 year loan, that, in two years, miraculously turned into an ARM… This was our second house, planned on staying at least 10 years, and, now, are months away from foreclosure due to 50% our doing and 50% this damn payment sky rocketing! We were ripped off.

    I had to laugh my hubby and me split $24 dollars each today. Let us know the costs. As you know we are broke people here. Also the lawyers and plaintiffs should also be investiigated for tricking us all. Someone needs to copy all the documents in the website before they take them off. And not sure if i am the only one here, but i never got notice on the first lawsuit which seemed to have paid off a little more???

    1st of all; I’d like to say AWESOME JOB to everyone copying old & new info, being proactive in researching info that may help our case! Conference call tomorrow with Mr. Knight P.A. hopefully we will have some recourse in going after what is rightfully ours & will make enough noise that, this will never happen to others again! If all who are interested in pursuing this & willing to put their substantial (LOL) checks to hiring an attorney ‘if we have a case’ please give me a standing head count!?     Peoople are forgetting about the so called 87 plaintiffs who got over $7,000. Why did they trick us? They need to also just receive 50 bucks. They needed us to make their case and then we get peanuts. Who can help us??
