Details: The Ameriquest mortgage class action lawsuit settlement includes all who originated their mortgage through Ameriquest or one of the other companies listed above. It’s important to note that even though your mortgage may not be currently services by Ameriquest, if it originated through them you may be eligible to submit a claim. In addition, the Ameriquest mortgage class action lawsuit settlement combines more than a dozen individual cases into one large settlement. If your mortgage loan with Ameriquest originated after December 14th, 2001 you’re likely included in the Ameriquest mortgage class action lawsuit settlement. The five classes included in this settlement are:

 

CLASS ONE: TILA RESCISSION CLASS

 

The TILA Rescission Class is a nationwide class of borrowers who at any time on or after February 8, 2003, (or, for residents of Massachusetts, at any time on or after February 8, 2002) have actually requested rescission in writing of their loans pursuant to applicable provisions of the Truth in Lending Act or state disclosure laws on or before December 1, 2009.

 

CLASS TWO: BAIT AND SWITCH CLASS

 

The Bait and Switch Class is a nationwide class of borrowers who meet one or more of the following criteria:

(i) loan records establish a final disclosed annual percentage rate that is at least 0.9% higher (as calculated pursuant to TILA) than the disclosed annual percentage rate (calculated pursuant to TILA) contained in preclosing written disclosures made to the borrower;
(ii) loan records establish that the borrower received a loan containing a prepayment penalty, but preclosing written disclosures made to the borrower described a loan without a prepayment penalty; or
(iii) loan records establish that the borrower received a loan containing a variable rate, but preclosing written disclosures made to the borrower described a loan containing a fixed rate.

 

CLASS THREE: DISCOUNT POINTS CLASS

 

The Discount Points Class is a nationwide class of borrowers who either entered into loans (i) made after December 14, 2001, and before February 3, 2003, on which they had to pay discount points in any amount; or (ii) made on or after February 3, 2003 on which they had to pay at least three discount points.

CLASS FOUR: WHOLESALE BORROWER CLASS

 

The Wholesale Borrower Class is a nationwide class of borrowers who paid an amount constituting more than 3% of their funded loan amount in settlement charges to Ameriquest or a mortgage broker.

CLASS FIVE: LOAN SERVICING CLASS

 

The Loan Servicing Class is a nationwide class of borrowers who paid Ameriquest default and delinquency fees or costs in an amount in excess of a total of $1,000. These fees and costs include fees listed in Ameriquest’s records as late fees, legal fees, phone pay non sufficient fund (NSF) fees, bad check non sufficient fund (NSF) fees, appraisal fees, inspection fees, and recoverable corporate advance fees.

 

Most people whose mortgage was originated by Ameriquest after December 14th, 2001 will fit into one of the classes above.     I want to know if there’s a list of people who received settlements from this lawsuit! I DON’T TRUST THIS COMPANY ONE BIT!! Seems to me that the number of people commenting on this site is pretty low… if there were 122,000 involved, wouldn’t there be a lot more screaming and yelling going on? How many of us are commenting – like 100 at the most?

    The judge that reviewed and approved this settlement needs to be slapped! We were RIPPED OFF – laws were BROKEN, people lost their homes, families were destroyed… how is $50 going to in any way near compensate us for the HELL they put us through? My son got a bigger settlement from a former employer who didn’t do anything close to what Ameriquest did to us!

    WHERE IS THE LIST OF WHO RECEIVED PAYOUTS FROM THESE RIPOFF ARTISTS?

    I feel like a fricking fool!! First I got duped by Ameriquest – they did so many illegal things with my loan…. forgeries, illegal notarizations, overstating of income, removed my ex-husband from the title, etc., etc., etc…. what made me think that NOW they were going to do anything different… that NOW they were going to be aboveboard and legitimate? This company was run by a bunch of lying thieves… they saw a way to rip us off and get away with it and never looked back!! Now they found a way to legally avoid getting sued by at least 122,000 of the people they defauded… how much did this cost them… 22 million!! Do the math – If they ripped each of us off for $10,000 each (lowball), they got away with $1,220,000,000 (that’s one billion, two hundred twenty million dollars). OK, so they had to pay out $22,000,000 – big deal, they still made off with $1,198,000,000!!!

    :'( I feel like we’ve been used to help the lawyers get rich. FIrst, I thought there were 700,000 claimants, but then I got my big check for 52.10 and it stated that there were only 170,000 claimants. I could almost bet there is definitely some deceit going on. I’ve been waiting 8 freaking months for $52.10..Had I known it, I would have not answered them and waited on the next lawsuit..This is definitely a bunch of mess, and where is the interest on the money. As I see it, we only helped the lawyers get fat wallets, because without our support, they wouldn’t have gotten a damn dime. What jerks…I’m pissed…I agree with Trish, I will never ever get into another lawsuit..I was counting on that money, I thought justice was finally done to Ameriquest, whereas it wasn’t.

    If anyone does find out if there is anything that we can do about this (such as hire a personal attorney) please post. We had two loans & received two checks, one for $48 and the other for $52. The math adds up. It was settled at $22million, subtract $200,000 for the foreclosure fund, 33% (or $14,740,000) for attorney, then 170,000 of us @ $50 ($8,5000,000). I feel like a idiot. I will not be a part of a class action suit again.

    This is shit a check for 52.10. When in the paper work it said that we would get at least 1000.00 where in the hell is it??? : They pay the lawyers very well and we all got f****ed… I do know that they had to get a warrent for all the files from Ameriquest / Argent.

    Well the only one left to help and I believe it was in one of his speeches before he got elected to be the President is President Obama. He should make some provisions to the ones in this suit. I believe I scrolled back and read something about that. Everyone start writing the White House. I believe that there is something we can do. Even though they say you can’t. There is the supreme court. If there is not justice for this, then this world is going down hill fast. So sad. On the bright side Maybe President Obama will read this and do something. He should he is our President.
