Top Class Actions viewers reportedly received payments from a $15 million settlement with A&W resolving claims it falsely advertised its sodas as containing real vanilla.
The settlement benefits consumers who purchased certain A&W root beer and cream soda products that included “made with aged vanilla” statements between Feb. 7, 2016, and June 2, 2023.
Plaintiffs in the false advertising class action claim A&W mislabeled its root beer and cream soda as containing aged vanilla. In reality, these products allegedly contained ethyl vanillin, an artificial vanilla flavoring.
A&W and Keurig Dr. Pepper agreed to pay $15 million to resolve the false advertising class action lawsuit. Direct TV TCPA class action rebates
Our readers report checks in the mail from a $16.85 million settlement with DirecTV resolving claims it violated federal law with telemarketing robocalls.
The settlement benefits individuals who received one or more telemarketing calls within a 12-month period from DirecTV while their number was on the National Do Not Call Registry.
According to the class action lawsuit, DirecTV bombarded consumers with unsolicited robocalls through AC1 Communications advertising its services. Plaintiffs in the case argue that, since they did not consent to the calls, they violated the federal Telephone Consumer Protection Act (TCPA).
DirecTV agreed to pay $16.85 million to resolve the TCPA class action lawsuit. Under the terms of the settlement, consumers could receive cash payments estimated at more than $461. Top Class Actions viewers reportedly received checks and electronic payments for $305.10.
The deadline to submit a claim with the settlement was Aug. 7, 2023.
The Direct TV TCPA class action lawsuit is Vance, et al. v. DirecTV, Case No. 5:17-CV-179, in the U.S. District Court for the Northern District of West Virginia.
Health Net FTA data breach settlement checks
Checks are in the mail from a $10 million settlement with Health Net resolving claims it failed to protect consumers from a 2021 data breach.
The settlement benefits individuals who received a data breach notification from Health Net informing them their information was compromised in a January 2021 data breach.
The Health Net data breach allegedly compromised sensitive patient information, such as birth dates and Social Security numbers. Plaintiffs in the class action lawsuit claim Health Net didn’t do enough to protect consumers from the data breach.
Health Net agreed to pay $10 million to resolve the data breach class action lawsuit. Under the terms of the settlement, affected consumers could receive up to $10,000 in expense reimbursement or other cash payments. One Top Class Actions viewer reports receiving payments from this data breach settlement.
The deadline to submit a claim with the settlement was Dec. 22, 2023.

A.C. Israel interest rates class action rebates

The settlement benefits borrowers who obtained a loan from Golden Valley, Silver Cloud and/or Majestic Lake at any time or who obtained a loan from Mountain Summit before Feb. 1, 2021.
According to the class action lawsuit, A.C. Israel Enterprises abused its tribal status to issue and collect loans with interest rates that exceeded federal and state limits. Plaintiffs argue these interest rates caused significant financial damages.
A.C. Israel agreed to pay more than $25.5 million to resolve the lending class action lawsuit.
Under the terms of the settlement, borrowers could receive a cash payment based on how much they paid in interest. One viewer reportedly received a check for $397.

Earl Enterprises data breach settlement checks
Our viewers report checks in the mail from a $650,000 settlement with Earl Enterprises resolving claims it failed to prevent a data breach that compromised several restaurant payment systems between 2018 and 2019.
The settlement benefits consumers who made a credit or debit card purchase at certain Buca di Beppo, Planet Hollywood, Earl of Sandwich, Chicken Guy, Tequila Taqueria and Mixology 101 locations between May 23, 2018, and March 18, 2019.
Plaintiffs in the data breach class action lawsuit claim Earl Enterprises failed to protect its systems, allowing hackers to access payment card information from numerous restaurant locations for nearly a year. According to the complaint, consumers faced financial damages and increased risk of damages due to the data breach.
Earl Enterprises agreed to pay $600,000 to resolve the data breach class action lawsuit. Under the terms of the settlement, consumers could receive up to $5,000 in expense reimbursement or promotional gift cards. One reader reportedly received promotional gift cards from this settlement via email.
The deadline to submit a claim with the settlement was Jan. 5, 2024.
The Earl Enterprises restaurant data breach class action lawsuit is Hymes, et al. v. Earl Enterprises Holdings Inc., Case No. 6:19-cv-644-Orl-41GJK, in the U.S. District Court for the Middle District of Florida.
