Health Net and other defendants have agreed to a nationwide $10 million FTA data breach class action lawsuit settlement.

The class members are those who received a notice from the Health Net defendants that their personal information was compromised in an FTA data breach that occurred on or around Jan. 20-22, 2021, and was announced on March 24, 2021.

The class action lawsuit claimed Health Net did not properly protect the personal information of its members and is therefore liable for the theft of the data — which included addresses, dates of birth, Social Security numbers and more. The class action lawsuit claims the class was injured due to the breach.

Health Net is an insurance company with 2,600 employees and 90,000 network providers who work for 3 million members throughout California, according to the company’s website. The company has been operating in California for more than 40 years.

Class members can also choose one of three options: a cash fund payment; three years of credit monitoring and insurance services; or cash payments of up to $10,000 per class member for reimbursement of documented losses due to the data breach.

Class members in California who choose the cash fund option and submit a valid claim are expected to receive an estimated $220 to $686 cash payment, while all others are expected to receive an estimated $110 to $343. 

Alternatively, class members may choose credit monitoring, which has an estimated retail value of $540 and includes up to $1 million of identity theft insurance coverage and three-bureau credit monitoring providing notice of changes to a class member’s credit profile.

The reimbursement option applies if a class member spent money remedying or addressing identity theft and fraud that was more likely than not related to the FTA data breach and was not reimbursed by insurance. It also can apply if a class member spent money to protect themselves from future harm because of the breach.

In addition, as part of the settlement, the defendants have agreed to take certain remedial and enhanced security measures.

The exclusion and objection deadline is Dec. 7, 2023.

A final fairness hearing in the settlement will take place Jan. 11, 2024.

The claim form deadline is Dec. 22, 2023.

Claims for documented loss payments must be supported by reasonable documentation such as credit card or bank statements, invoices, telephone records and receipts.
