American Eagle Outfitters signTop Class Actions viewers are beginning to receive checks in the mail from the American Eagle TCPA class action settlement worth as much as $242.46.

The American Eagle class action lawsuit alleged that customers were contacted by the clothing retailer through text with advertisements.

The plaintiffs said that American Eagle never obtained consumers permission to contact them via text – an alleged violation of the Telephone Consumer Protection Act.

The American Eagle class action lawsuit was settled in 2017. Under the terms of the settlement, American Eagle agreed to pay $14.5 million to exit the class action lawsuit.

The retailer admitted no liability, but Class Members were expected to receive a payment between $142 to $285 and were not required to provide any proof of purchase to submit a claim.

If you submitted a claim in the American Eagle class action lawsuit and are wondering where your settlement check is, keep an eye on your mail box.

Class Members include those who received a text message sent by or on behalf of American Eagle Outfitters, who did not consent to American Eagle sending those advertisements, between April 8, 2010 and Jan. 24, 2017.

It was estimated that the Class would include more than 600,000 individuals based on American Eagle call records.

The deadline to submit a claim in the American Eagle TCPA class action settlement was May 24, 2017 and the final hearing was held Aug. 22, 2017.

Final approval in the settlement was granted on Sept. 11, 2017 and an appeal to the American Eagle TCPA settlement was lodged that October. The settlement was then affirmed by the Second Circuit Court of Appeals in April of 2019, but was stayed on June 18, 2019, pending a petition to the United States Supreme Court.

What gives? I have yet to receive a payment as of today 3/30/2020, like most others posting on here. However a very select few posted back during the 1st week of Feb. that they received checks between $100 and $200+…. ??? Has anyone heard if perhaps settlements are being paid in different waves perhaps?

Or does something seem fishy here? I normally am put off by the complaints left here or the never-ending pleas to “add me” long after the settlements are closed etc. But some of us posting here are actually aware of the settlement activity and find that this is pretty much our only place to view possibly current info. I cannot begin to tell you how many claims I have submitted correctly etc., for which I have never received a settlement and was unable to speak to the assigned admin between the times that payments were being made and activity in relation to the case subsequently ended.

I wish we could actually reach most claim administrators by phone as suggested. I have found most times any phone calls go to an unmanned telephone with nothing but 15 recorded minutes of irrelevant information to have to listen to. Anytime I’ve actually been able to leave a message in order to receive a return call from various claims administrator’s in the past, I’d do so, yet I remain terminally frustrated, as other than one instance, I have never heard back from anyone in regards to my messages.

This is frustrating beyond belief and frankly speaks volumes to what I now believe about most class action lawsuits! That they are simply additional opportunities for the general public to get defrauded, scammed, and violated for simply being consumers.
