Jaguar Land Rover Americans with Disabilities Act Class Action Lawsuit Overview:
- Who: Jaguar Land Rover North America, LLC
- What: Jaguar Land Rover North America is accused of violating the Americans with Disabilities Act by having a website that isn’t accessible for blind and visually impaired people.
- Where: New York
A legally blind woman repeatedly tried to buy a car for her son on the Jaguar Land Rover North America website, but was denied because the website is not accessible to consumers using screen-reading software, a new nationwide class action lawsuit alleges.
Plaintiff Michelle Tenzer-Fuchs filed the class action complaint against Jaguar Land Rover North America, LLC last Wednesday in a New York federal court.
She alleges the company has violated the Americans with Disabilities Act (ADA) through its failure to make its website fully accessible to blind or visually-impaired people.
Tenzer-Fuchs, who uses a screen-reading software, says she made multiple visits to www.jaguarhuntington.com as recently as August this year to buy a new Jaguar for her son.
“Despite her efforts, however, [she] was denied a shopping experience similar to that of a sighted individual due to the website’s lack of a range of features and accommodations, which effectively barred Plaintiff from being able to make her desired purchase,” the complaint states.
Tenzer-Fuchs says the issues started on the homepage of the site, where she immediately found she was unable to figure out how to navigate to other pages because her reader could not read several of the page options.
The issues persisted, and indicated that many features on the website lack adequate alt. text, which is the invisible code embedded beneath a graphical image, Tenzer-Fuchs says.
Jaguar Website Violates Americans With Disabilities Act, New Class Action Claims
She says Jaguar Land Rover’s denial of full and equal access to its website is a violation of her rights under the ADA.
“Defendant’s website contains various access barriers that make it extremely difficult – if not impossible – for blind and visually-impaired consumers to attempt to complete a transaction.”
Tenzer-Fuchs is looking to represent all legally blind individuals in the United States who couldn’t access the website due to the issues.
She’s seeking a permanent injunction to initiate a change in the company’s corporate policies, practices, and procedures so that its website will become accessible to blind and visually-impaired consumers. She’s also seeking certification of the class action, damages, interest, fees, costs and a jury trial.
This is not the only class action lawsuit Jaguar Land Rover North America is currently facing.
Last month, a complaint was filed alleging Jaguar Land Rover’s 2017-2021 Range Rover Sport diesel vehicles contain a defective fuel system that decreases its performance if it is driven only on city streets.
