Man Asks Court to Restrain Enforcement of Federal Transportation Mask Mandate

A Washington D.C. man has filed a lawsuit against the federal government and Orlando Airport calling for the government to immediately stop enforcing the national mask mandate, saying it is unconstitutional.

The lawsuit was filed in Orlando on June 7 by Plaintiff Lucas Wall, who alleges that he was left stranded in The Villages in Florida, where he was caring for his mother, after he was not allowed to board a flight after declining to put on a face mask. Wall had a ticket on a Southwest flight to fly from Orlando to Fort Lauderdale.

Wall alleges that the federal mask mandate enforced by Orlando Airport, Transportation Security Administration, Centers for Disease Control and Prevention, and President Joe Biden (all defendants in the lawsuit) is unconstitutional, especially while traveling within a state.

Wall is bringing the lawsuit in an attempt to end enforcement of the Federal Transportation Mask Mandate (FTMM) and the International Traveler Testing Requirement (ITTR), saying they violate the Administrative Procedure Act (APA).

“The defendants’ goal of easing the impact of COVID-19 is laudable but grossly misguided,” Wall says in the class action lawsuit.

“In attempting to mandate masks for all American travelers and to require anyone flying into the United States – even those fully vaccinated and/or with natural immunity – to obtain an expensive coronavirus test within three days of departing a foreign nation, defendants have acted without statutory authorization or following the rulemaking process required by the Administrative Procedure Act.”

According to Wall’s lawsuit, the FTMM and ITTR “are arbitrary and capricious” because the federal agencies failed to reasonably explain why other measures were insufficient to tackle the “rapidly declining COVID-19 infection and death rates.”

Wall had planned to travel to see friends and family during the summer and is fully vaccinated, the claim states.

It adds that Wall cannot “tolerate wearing a mask” due to a generalized anxiety disorder.

“I have never covered my face. I tried a mask a couple times for brief periods last year, but had to remove it after five or so minutes because it caused me to instigate a feeling of a panic attack, including hyperventilating and other breathing trouble,” Wall said.

In the claim, Wall says that he submitted an application to be exempt from the federal mask requirement when he purchased his tickets with Southwest, saying it was illegal to require advance notice of disability accommodation. And he added that Southwest’s face mask exemption policy was illegally discriminating against passengers with disabilities, saying that he didn’t “pose a threat to anyone.”

He added that he also strongly opposes any mask mandate on other grounds, “including that it’s a violation of my civil liberties to be ordered to block my nose and mouth, my only two sources of oxygen.”

Wall, who is representing himself, also wants to eliminate mask requirements outlined by the Greater Orlando Aviation Authority, saying the mandates are “in direct violation of a Florida executive order prohibiting any subdivision of the state from requiring face coverings.”

Wall is suing for violation of the Administrative Procedure Act and 10th Amendment. He seeks damages, enjoinment orders, injunctive relief, and legal fees supposing he hires counsel.

    This has nothing to do with politics. Why is it people like you always turn in that direction? This has to do with the simple scientific fact that cloth masks cannot prevent the spread of any virus. I know I work in Virology. Second if you want your Constitutional Rights trampled on go for it. The rest of us will fight for ours and you’re with or without your help. So, he a sheep.

    You people complaining about masks are just plain ridiculous. They were required for EVERYONE’S SAFETY!!! Private companies have the right to require them still and I applaud them for doing so. Ironically the “Non-Maskers” are also mostly the “Non-Vaxxers”. This whole Covid thing NEVER should of been politicized but we all know that the t-RUMP did exactly that. Kind of ironic too that the new Delta variant (the one from India) that is up to 50% more transmissible and is all over the USA is spreading rapidly in the states with low vaccine rates (all Red states).. A lot of the people still wearing masks are doing so because we know that a lot of people not wearing them are still spreading the disease!!!

      Masks do not work. They do harbor disgusting bacteria however. Toilet plumes eject E Coli onto them and it sits in front of your mouth getting it on with other bacteria ? so disgusting. Masks were sent to a lab and cow herpes was found too. Disgusting ?

    During the beginning of covid 3-2020, I purchased a shotgun and 3 days later a handgun. The DOJ delayed the first shotgun purchase but approved the handgun. I was able to pick up the handgun but had to wait 30 days to come back undetermined for the first DROS. The ffl would not release even though I just picked up the handgun on approved from them. After writing letter and pleading with them, thier attorneys gave ok to release after approx 45 days. Now a little over a year later and I am on delay again for a handgun purchase. The last notice I received had a brief message about my name connected with a stolen firearm. I find that interesting because someone elses comment said the same. I have done several background NICS checks on myself trying to locate what they are finding and all come back completely blank for any criminal records. It is extremely frustrating for a law abiding citizen without any restrictions for owning a firearm to put up with these type of errors of judgement.

          Yes he has second amendment rights, and I have no problem with his owning firearms as long as he is mently fit.

          The issue is, he won’t find much help in his fire arms dilemma posting under an article discussing the requirement of face masks.

    Please add me for the abuse of flying 19 times during Covid so far. At the height of Covid first flights, The masks were optional after boarding and sitting down. This was for two different flight on Southwest. Then they jammed it to gather filling up the planes later months and overdid it with the mask mandate. TSA was absolutely ridiculous with this, so please add me!

      I find it hypocritical that the very airlines requiring face masks are now at loggerheads with the CDC over vaccinated passengers due to potential blood clotting. So which is it? To vax? Or not to vax? The answer doesn’t even matter because it’s no one’s business but the individuals’.

    How many parents have been removed from flights?! I have a handicapped husband who constantly removes his mask and I fear we will be kicked off flights! This is insanity… I am a grown woman who isn’t asking for a caregiver and can decide for myself if to wear a mask or not!!! It is not up to the government!!!

        No, it’s not. It’s each individual’s responsibility. Your health is your responsibility. If what you are saying were true, where is their action and individual requirements on fast food obesity and diabetes? Or on fake food, like gmo’s, wheat, corn, sodium benzoate (a known and documented carcinogen) that causes diseases? Or the implementation of required daily exercise to prevent disease and death? There isn’t, because your health is not their responsibility not even during a fake pandemic. They only have the right to initiate under an EMERGENCY. 19 months into a virus that causes less death than the annual flu is not defined as an emergency pandemic.
