Man Asks Court to Restrain Enforcement of Federal Transportation Mask Mandate

A Washington D.C. man has filed a lawsuit against the federal government and Orlando Airport calling for the government to immediately stop enforcing the national mask mandate, saying it is unconstitutional.

The lawsuit was filed in Orlando on June 7 by Plaintiff Lucas Wall, who alleges that he was left stranded in The Villages in Florida, where he was caring for his mother, after he was not allowed to board a flight after declining to put on a face mask. Wall had a ticket on a Southwest flight to fly from Orlando to Fort Lauderdale.

Wall alleges that the federal mask mandate enforced by Orlando Airport, Transportation Security Administration, Centers for Disease Control and Prevention, and President Joe Biden (all defendants in the lawsuit) is unconstitutional, especially while traveling within a state.

Wall is bringing the lawsuit in an attempt to end enforcement of the Federal Transportation Mask Mandate (FTMM) and the International Traveler Testing Requirement (ITTR), saying they violate the Administrative Procedure Act (APA).

“The defendants’ goal of easing the impact of COVID-19 is laudable but grossly misguided,” Wall says in the class action lawsuit.

“In attempting to mandate masks for all American travelers and to require anyone flying into the United States – even those fully vaccinated and/or with natural immunity – to obtain an expensive coronavirus test within three days of departing a foreign nation, defendants have acted without statutory authorization or following the rulemaking process required by the Administrative Procedure Act.”

According to Wall’s lawsuit, the FTMM and ITTR “are arbitrary and capricious” because the federal agencies failed to reasonably explain why other measures were insufficient to tackle the “rapidly declining COVID-19 infection and death rates.”

Wall had planned to travel to see friends and family during the summer and is fully vaccinated, the claim states.

It adds that Wall cannot “tolerate wearing a mask” due to a generalized anxiety disorder.

“I have never covered my face. I tried a mask a couple times for brief periods last year, but had to remove it after five or so minutes because it caused me to instigate a feeling of a panic attack, including hyperventilating and other breathing trouble,” Wall said.

In the claim, Wall says that he submitted an application to be exempt from the federal mask requirement when he purchased his tickets with Southwest, saying it was illegal to require advance notice of disability accommodation. And he added that Southwest’s face mask exemption policy was illegally discriminating against passengers with disabilities, saying that he didn’t “pose a threat to anyone.”

He added that he also strongly opposes any mask mandate on other grounds, “including that it’s a violation of my civil liberties to be ordered to block my nose and mouth, my only two sources of oxygen.”

Wall, who is representing himself, also wants to eliminate mask requirements outlined by the Greater Orlando Aviation Authority, saying the mandates are “in direct violation of a Florida executive order prohibiting any subdivision of the state from requiring face coverings.”

Wall is suing for violation of the Administrative Procedure Act and 10th Amendment. He seeks damages, enjoinment orders, injunctive relief, and legal fees supposing he hires counsel.

    I agree with this guy! It’s EXCESSIVE now with all the restrictions. Those of us with disabilities would like to have our lives back!

    Plaintiff Wall is the classic example of a snowflake who hasn’t ever won his state’s lottery so he’s suing. It’s the American way, is it not?

    Ok now in a lot of places they say if you’ve had your vaccine you don’t have to wear a mask. (The Honor System) Do you think that really works? Hell no it doesn’t. I guarantee the ones that are lying about being vaccinated (Honor System) and not wearing the masks are the same idiots that have been crying about having to wear the masks since the beginning when all this started. I’ve been vaccinated and I still wear a mask in stores / airplanes / public areas. I mean hell the vaccine still hasn’t been proven to be 100% effective. Let’s all just do what we gotta do so we can get this thing over and done with and not drag it on longer than it has to be.

      Masks do not work. They do harbor disgusting bacteria however. Toilet plumes eject E Coli onto them and it sits in front of your mouth getting it on with other bacteria ? so disgusting. Masks were sent to a lab and cow herpes was found too. Disgusting ?

    The order saying places can not require mask in Florida does not go into effect until July 1st. It does not cover places where a higher government is in control.(airports, federal courthouses) The only aspect of his case that he might be able to argue is the disability.

    I only agree with him now because so many states have dropped the mask mandate. It should be optional at this point or with the vaccine. I have received both my shots.

    BEFORE READING, REMEMBER WE ARE ALL ENTITLED TO OUR OWN OPINIONS. I think this guy is just a complete idiot. Plan and simple. Don’t want to wear a mask then drive. Does he have this same issue when trying to grocery shop? Just suck it up buddy. Since when did some many of us people in this world become such babies / sissy’s / crazy? (A guy walks into a grocery store and is asked to put on a mask because of the stores mask policy, so he then shoots the person who asks him to put on the mask. I mean come on really! I rest my case. This world has gone to crap.)

      I totally agree with you . I’m a retired R,N. and dint like wearing a mask, so instead of working in the OR, I chose to work recovery room . If the guy has anxiety , his doctor can give him a few Ativan for anxiety . I think many airline passengers’ anxiety levels rise when traveling by air.

      Yes, he can suck it up, for the sake of others that don’t have the immunity . My mom , who was a woman of faith , used to say to me, “ offer it up to God, “ which meant I should endure the sacrifice for God’s grace .

      We can’t all have things our own way. This ain’t Burger King.

      The point is no person or business or other entity has the right to force a medical procedure on ANYONE. That’s why the Nuremberg Trials were held…to protect mankind from ever having to be a lab rat against their will.

    This is awesome. He is 100% right. All the people who threw on those masks thinking they HAD to wear them seem to have forgotten we have a US CONSTITUTION. Good job Wall. I cannot believe so many just threw on those masks like little robots. Communist lovers much?
