Man Asks Court to Restrain Enforcement of Federal Transportation Mask Mandate

A Washington D.C. man has filed a lawsuit against the federal government and Orlando Airport calling for the government to immediately stop enforcing the national mask mandate, saying it is unconstitutional.

The lawsuit was filed in Orlando on June 7 by Plaintiff Lucas Wall, who alleges that he was left stranded in The Villages in Florida, where he was caring for his mother, after he was not allowed to board a flight after declining to put on a face mask. Wall had a ticket on a Southwest flight to fly from Orlando to Fort Lauderdale.

Wall alleges that the federal mask mandate enforced by Orlando Airport, Transportation Security Administration, Centers for Disease Control and Prevention, and President Joe Biden (all defendants in the lawsuit) is unconstitutional, especially while traveling within a state.

Wall is bringing the lawsuit in an attempt to end enforcement of the Federal Transportation Mask Mandate (FTMM) and the International Traveler Testing Requirement (ITTR), saying they violate the Administrative Procedure Act (APA).

“The defendants’ goal of easing the impact of COVID-19 is laudable but grossly misguided,” Wall says in the class action lawsuit.

“In attempting to mandate masks for all American travelers and to require anyone flying into the United States – even those fully vaccinated and/or with natural immunity – to obtain an expensive coronavirus test within three days of departing a foreign nation, defendants have acted without statutory authorization or following the rulemaking process required by the Administrative Procedure Act.”

According to Wall’s lawsuit, the FTMM and ITTR “are arbitrary and capricious” because the federal agencies failed to reasonably explain why other measures were insufficient to tackle the “rapidly declining COVID-19 infection and death rates.”

Wall had planned to travel to see friends and family during the summer and is fully vaccinated, the claim states.

It adds that Wall cannot “tolerate wearing a mask” due to a generalized anxiety disorder.

“I have never covered my face. I tried a mask a couple times for brief periods last year, but had to remove it after five or so minutes because it caused me to instigate a feeling of a panic attack, including hyperventilating and other breathing trouble,” Wall said.

In the claim, Wall says that he submitted an application to be exempt from the federal mask requirement when he purchased his tickets with Southwest, saying it was illegal to require advance notice of disability accommodation. And he added that Southwest’s face mask exemption policy was illegally discriminating against passengers with disabilities, saying that he didn’t “pose a threat to anyone.”

He added that he also strongly opposes any mask mandate on other grounds, “including that it’s a violation of my civil liberties to be ordered to block my nose and mouth, my only two sources of oxygen.”

Wall, who is representing himself, also wants to eliminate mask requirements outlined by the Greater Orlando Aviation Authority, saying the mandates are “in direct violation of a Florida executive order prohibiting any subdivision of the state from requiring face coverings.”

Wall is suing for violation of the Administrative Procedure Act and 10th Amendment. He seeks damages, enjoinment orders, injunctive relief, and legal fees supposing he hires counsel.

    It continues to baffle my mind that we are wearing masks in the first place, anywhere! The worst part is that people are so caught up in this silliness, that not one of them recognizes the stupidity in all of this. First of all, a mask is not preventing you from catching anything, nor is it keeping you healthy. Secondly, to demand that everyone wear a mask, or get a vaccination is criminal, and this guy is correct – unconstitutional and a violation of everyone’s civil rights. If you want to wear a mask, or get a vaccine, then do so. However, do not infringe on my rights to make yourself feel better. That is all this is about. The most ridiculous part is that all those rushing out to be vaccinated against supposed COVID, are probably unhealthy in other areas. People have also forgotten the fact, that there are so many infectitious diseases in the air, and no one is making a big deal out of that. TB is still one of the most active, and prevalent airborne diseases out there, yet no one is rushing out to get a vaccine for that, nor do people talk about it. Go figure….Masks on flights???? Is ridiculous, and always will be ridiculous!

        I traveled by air to and from Asia for years and not once did I see any Asian passengers wear a mask. What are you up to with that blatant rubbish response? A troublemaker, I presume.

        Masks do not work. They do harbor disgusting bacteria however. Toilet plumes eject E Coli onto them and it sits in front of your mouth getting it on with other bacteria ? so disgusting. Masks were sent to a lab and cow herpes was found too. Disgusting ?
        Not true, Asians do not wear masks on flights. I have flown to China plenty of times. They only wear them which is rare for actually HAVING symptoms. Dumb either way

    OMG most ridiculous claim. 1: Southwest is a private company and can make their own rules. 2: the air port was going by a FEDERAL MANDATE. I am so sick of these people who think their ‘rights’ have been denied. I have rights too and I don’t want a fool like you sitting next to me on a plane or any where else for that matter. It’s just a stupid mask, what the hell is the problem????

      The problem is that peoples’ rights are being violated. Do you really think someone sitting next to you on a plane, or standing next to you in the grocery store, you are going to catch something? I can assure you, if you caught something, it probably has more to do with your weak immune system, and your health. In my practice, I notice that those who are really healthy, do not whine and cry about catching some sickness, or disease….food for thought…

      The masks, except for N95 CANNOT stop, nor prevent the spread of COVID-19. A virus cannot be stopped with cloth. I actually work in a laboratory and we use glass holds and nitrate gloves as our first defense, it also depends on the media we work with. Second you mention federal mandate, this is exactly his point as being unconstitutional. Read the Constitution/Bill of Rights and you will be enlightened and understand why people are speaking up.

    No business should involve itself or feel empowered to the point of insisting that their customers wear a mask. This whole pandemic thing gets phonier and phonier with each passing day. More businesses need to refuse to be a part of it all.

    If Wall was caring for a parent, has a generalized anxiety disorder and doesn’t care to wear a mask he has a few problems in play.

    Caring for an elderly relative without a mask is risky enough but depending on where his mother was located it could be fatal. If she is in a nursing environment that’s the worst possible place to avoid wearing a mask. Avoiding wearing a mask in a busy environment like an airport or even an airplane is just as risky. He may not know and the rest of the individuals around him certainly don’t know whether or not he’s carrying a novel coronavirus.

    Next up, if he has a general anxiety disorder he needs to seek medical treatment for that. There are easy therapies and plenty of medications to take for it.

    Lastly, an airline is an entity that may make their own rules, as is an airport. Any requirements to entry can apply to these locations at any point in time. If Wall chooses to not follow those rules he can find alternate transportation.

    The CDC is in place to protect us from individuals just like this.

    Wall can take his vehicle to any location he pleases and avoid an airport. He can make arrangements to do a Zoom call with Mom and or her caregivers.

    Stop caving in to crybabies and snowflakes who science deny and cause others to die.

      First, if he has been vaccinated, he is at the same risk of carrying the virus as someone who may get struck by lightning…six times lol! This is from the scientific literature, so insisting otherwise (that he may carrying the virus) is indeed science-denying.

      Second, the treatment for GAD (General Anxiety Disorder) does not eliminate the triggers or eliminate the symptoms. The treatment only teaches emotion regulation as well as avoidance of triggers, such as covering the nose and mouth. I both have GAD and have been treated for years. I am also a licensed social worker doing individual counseling with dozens of patients every week. His statements about GAD are completely true. There is no cure for GAD and no treatment that “makes the symptoms go away” within legal parameters. Your solutions sound like you’ve derived that belief of “get treated and then it won’t be a problem” from your television. It doesn’t work that way. Maybe in a couple hundred years, but not in our lifetimes.

      Lastly, a private company can make rules of whatever they want, but only as long as those rules are not arbitrary, capricious, unreasonable, or discriminatory. This mask mandate is all of these. Every single one LOL. I own a business – a private psychology practice – and I can’t discriminate against anyone for a known and recognized disability. That has been the US law since the 1960s when the Democrat Party continued to oppose segregation and the Republican Party began to pass a series of antidiscrimination laws to counter the negative effects of the Democrat Party’s KKK threatening businesses into discriminating. This is all information easily available on Google and found on House dot Gov even. I can provide you with several links if you aren’t good using Google.

      The CDC is a private company and equally as corrupt as both political parties. The CDC and the NIH were the ones that ORIGINALLY FUNDED the gain-of-function tests that created the Corona Flu. The CDC protects no one but themselves. If the last 18 months of contradictions and science denying about mask studies over the last 18 months hasn’t proven this, you haven’t been watching LOL.

      I think it’s ironic and funny you finalize your post with an insult towards what you call “crybabies” and “science deniers”. The only science deniers today are ones insisting boys can be girls if they believe they are, that women and men physically have no differences, and that a microbe on Mars is “life” but a fully formed child in the womb is just a clump of cells (and use this science-denying to justify the genocide of over 1,000,000 aborted children every year).

      You may want to reassess your terminology. It seems as outdated as a mask mandate is today. Godspeed! :)

        I agree, you are an excellent orator. However, I did catch one mistake in your otherwise excellent message. “That has been the US law since the 1960s when the Democrat Party continued to oppose segregation …” I’m sure you meant “integration” and not “segregation”. The Democrat Party, aka Dixiecrats, have fought for segregation with great fervor right up to today. Today’s Democrat Cancel Culture is just another iteration of Jim Crow and Antifa is a new incarnation of KKK. Never give a Democrat the benefit of the doubt. I don’t want other readers to ever assume the Democrats were in favor of integration when history shows otherwise. Lockdowns and face masks are the Democrat wet dreams.

      Wrong JOel. NO business policy, rules or mandates supersede the US Contitution-NONE. Since there is NO LAW that was passed by both houses of our govt and signed into law by POTUS, there is NO LAW.
