Google Drive class action lawsuit overview:

A new class action lawsuit alleges Google misleads consumers into believing that their data stored on Google Drive is secure from being deleted.

Plaintiff Devin Rose claims that data stored on Google Drive, in reality, can be deleted without warning and that Google fails to warn consumers about this, according to a Law360 report. 

The Google Drive class action lawsuit alleges Google announced two years ago that it would start deleting data stored on unused or abandoned accounts, but that media coverage reported the new policy would not affect paid accounts or active Google Drive storage accounts that were being paid for. 

Despite this, Rose argues that despite being a Google Drive subscriber for four years, his files were deleted automatically and without him intentionally doing so. 

“To this day, defendants continue to sell Drive subscriptions without disclosing that their subscribers’ files can be deleted without warning to protect their pecuniary interests, to the severe detriment of the public, including plaintiff and the class,” the Google class action says. 

Rose reportedly wants to represent a California class of consumers who paid for a Google Drive subscription but whose files were deleted without warning. 

Google Drive unaware their data could be deleted, class action says

Rose claims Google never warned Google Drive users, including paid subscribers, that their data could be deleted without their knowledge, the Law360 report says. 

The class action lawsuit further alleges that consumers who did purchase Google Drive subscriptions were relying on representations from Google that their files would remain safe.

According to the Google class action, “Defendants, through agreement and consciously paralleled behavior, knowingly and intentionally sold Drive subscriptions without sufficient warning that files saved in Drive could be deleted automatically,” as reported by Law360. 

Rose reportedly claims Google is guilty of violating California’s Unfair Competition Law and Consumer Legal Remedies Act.  The plaintiff demands a jury trial and requests Google be ordered to repay class members or pay restitution. 

In other news, Google recently agreed to pay $630 million resolve claims from all 50 states that it violated antitrust laws by monopolizing app distribution and in-app billing services through its Google Play Store.
