Equifax has agreed to a $100 million class action settlement to resolve claims it provided inaccurate credit information about millions of Americans applying for loans, insurance or services from other businesses that use credit information.
The Equifax settlement covers U.S. residents whose credit scores or credit attributes, as identified in the online modeling system (OMS) analysis, differed from what they would have been without the OMS issue and were reported by Equifax to a third party in connection with a class transaction.
Equifax is a consumer credit reporting agency that collects and aggregates information on over 800 million consumers and more than 88 million businesses worldwide.
Equifax denies it violated the Fair Credit Reporting Act (FCRA) but has agreed to a $100 million class action settlement to resolve the class action lawsuit.
The Equifax FCRA violations lawsuit claims that during three weeks in March and April 2022, Equifax provided inaccurate credit information about millions of Americans applying for loans, insurance or services from other businesses that use credit information.
The class action lawsuit claims that Equifax reported information that was affected by a coding error in one of its computer systems.
Under the terms of the Equifax settlement, class members who submit a valid and timely claim can receive an estimated $95 to $280. Payments will be distributed on a pro rata basis from the net settlement fund after court-approved fees, expenses and administration costs are deducted. The actual payment amount may be higher or lower depending on the number of valid claims submitted.
The deadline to opt out of or object to the Equifax settlement is Nov. 27, 2026.
The final approval hearing for the Equifax FCRA violations class action settlement is scheduled for Jan. 22, 2027.
To receive class action settlement benefits, class members must submit a valid claim form by Dec. 28, 2026.
