Walmart Class Action Lawsuits, Recalls Overview: 

  • Who: Walmart has already faced a number of class action lawsuits and product recalls this year. 
  • Why: The class action lawsuits and recalls revolve around product safety, false advertising and wage violation claims, among other things. 
  • Where: Walmart is nationwide. 

Walmart is a popular retail location for consumers looking to purchase a wide variety of different products and services.

The retailer’s extensive product line, however, means it is often on the defensive when it comes to class action lawsuits, and several product recalls have also already occurred this year.

Class action lawsuits and recalls affecting Walmart include claims revolving around false advertising, wage violations and issues with product safety, among other things. 

Walmart Accused Of False Marketing, Toxic Chemical Use, Warehouse Abandonment

Last month, Walmart faced claims it falsely marketed lidocaine patches it sells as being “maximum strength.” 

The consumers behind the class action lawsuit claim the lidocaine patches contain less lidocaine than competing brands, making their “maximum strength” representations false. 

Further, consumers claim the lidocaine patches don’t stay on the body for as long as they are advertised. 

Also last month, Walmart, along with Kohls, agreed to pay $5.5 million to resolve the federal government’s claims that they falsely marketed their rayon-based products as eco-friendly

The Federal Trade Commission (FTC) alleged Walmart and Kohls used toxic chemicals to turn bamboo into the rayon used in the products. 

Walmart was ordered to pay $3 million by the FTC while Kohls will pay the remaining $2.5 million of the settlement. 

The retailer found itself on the wrong end of another class action lawsuit last month after two warehouse companies claimed Walmart “tricked” them into housing an unsellable disinfectant product. 

The warehouse companies argue Walmart has failed to pay them for storing the unsellable Disinfex brand disinfectant wipes and has since cut communication with the businesses entirely. 

Vans Claims Walmart Sells ‘Knockoff’ Shoes

Walmart also faces a lawsuit from Vans, which claims the retailer is selling “knockoff” versions of its popular shoes.

In January, Walmart implored the judge overseeing the case to deny Vans’ request for a temporary injunction that would have required it to stop selling the shoes at the center of the claims. 

Walmart argued it would cost the company tens of millions of dollars if it were to take the shoes off the shelves. 

Vans later argued during a hearing at the end of February that the situation has left it facing an “existential crisis” and put its bottom line in “mortal peril.”

Walmart, CaptureRx Face Data Breach Suit

In March of 2021, meanwhile, Walmart, along with CaptureRx, faced a class action lawsuit revolving around the companies’ handling of a February 2021 data breach. 

The consumer behind the class action lawsuit claimed Walmart and CaptureRx “betrayed” them by not securing their private information during the data breach. 

CaptureRx would ultimately agree to pay $4.75 million to resolve their part of the claims in a proposed settlement announced in March. 

Walmart Workers File Suit, Claim Wage Violations, Discrimination

Walmart’s employees have filed class action lawsuits against Walmart over their treatment.

In January, a federal judge denied Walmart’s request for summary judgment on allegations it misclassified its night managers as being exempt from receiving overtime pay. 

Walmart argued that the statute of limitations on the claims made under the New Jersey Wage and Hour Law had already run out; however, the judge sided with the workers. 

Also in January, Walmart faced claims it discriminated against its female truck drivers by requiring them to either wear the men’s pants provided or to purchase and launder their own work-compliant uniform out of pocket

The worker behind the class action lawsuit claims her complaints to Walmart’s human resources department have not been attended to. 

Parents Worry About Wamart Baby Wipes, Recalls Affecting Walmart Include Potato Chips, Bike Helmets

Earlier this month, parents expressed concern after there was a report of a potential recall for Walmart’s Parent’s Choice brand baby wipes. 

The confusion began after Walmart removed a select number of Parent’s Choice brand baby wipes from stores over what it called a “quality issue.” 

Information surrounding the product removal reportedly became distorted and culminated with one parent unfoundedly suggesting the baby wipes were contaminated with toxic metals. 

In March, meanwhile, around 90,000 bike helmets sold at Walmart and other locations were recalled after it was discovered they were not in compliance with federal safety standards

The recalled bike helmets included 960 of Segway’s Ninebot Children’s Bicycle Helmets and 89,000 of Sekar International’s Dimensions Bluetooth Speaker Helmets. 

Also in March, Walmart initiated a recall for 2,555 cases of its Great Value brand tortilla chips over concerns the products had been contaminated with metal pieces

    I Brought Many Items That Was On Recall And Didn’t Know it Wen I Taken It Back To The Store they didn’t give my money back even my copy machine it just stopped working and I paid 189.00 dollars for it I would like to be added to this lawsuit Please

    I am a direct victim of Walmart in Murfreesboro TN. I am currently charged with theft, for a $10 pack of razors in which I had bought on a previous trip to the Walmart. Once I got home one day, I discovered that I had purchased the Gillette Fusion razors instead of my regular Gillette Proglide brand, so I took them to exchange them. At customer service they refused the exchange because they said they were a pharmacy item and they don’t take back those items. And because I had barely opened the top (which was just a small crack in the package).
    Anyway, all of that is fine and dandy, but check out what these people did to me. I said “ok” of course and didn’t argue, and just left the customer service desk to look around like on any other shopping trip. All the while I had my razors that they would not exchange with me.
    I’m not sure the exact dates or how many days later (That’s why I need an Attorney), but maybe a week or two later I estimate….I was sitting in my car across the street in another shopping center about to go inside of Target, and I was blocked in and surrounded by 1 police car at first, then more started arriving plus a Fire truck! The cop lightly taps on my door so I slowly open it, and suddenly he just grabs me and trips me as I’m stepping out, with my arms bent up behind me and I’m freaking the heck out like “What is going on”! All of this has to be on Camera too by the way. My story from the beginning at Walmart when I stepped out of my car with my razors and walked inside to exchange them.
    But anyway, the cop starts patting on me and acting frantic and demanding as heck! And says “where is your wallet”?!, “You have an ID”! I say simply “Yes in my back pocket”. That’s when he puts cuffs on me and says “Your not under arrest I’m just protecting you and myself and following procedure” haha I’m serious as a heart attack.
    I’m thinking “What procedure, and why”.
    So he gets my wallet and ID and later I realized that he’s doing this as if he knows what he is up to. And suspects he has found, who he has been called to find, to pick up!
    So he the cop comes back immediately and tells me with a sly little smile “You have a warrant for your arrest”. I swear I don’t remember a time in my life where I had been more shocked. Or more humiliated as people walk by and I’m doing nothing wrong, AND NEVER DID ANYTHING WRONG!
    He ignores me as I ask him over and over “Why”, “Why” of course.
    But finally when I am in the back of his cop car on the way to jail, he tells me. “You have a theft charge for stealing from Walmart for $9.97”!!!!! I almost had a heart attack.
    So apparently someone at this Walmart in Murfreesboro where I currently live, saw me leave that store that day with the “Razors I BROUGHT BACK TO EXCHANGE, AND THAT I WALKED INTO THAT STORE WITH…..And reported to someone, or called police right then I’m not sure. But reported that I had walked out stealing a pack of razors. The pack of razors I never stole, but brought back to exchange. And all of this is on camera it has to be. From the moment I pull in and step out of my car with the razors, and walk inside straight to customer service with them, And then as I walk away with the razors carrying only mine the entire time! I’ve been to court twice and no one ever shows up!
    I’ve found out the name of the person who swore on an Affidavit that he witnessed me stealing a pack of razors!
    And I have been turned down for 2 jobs for having a theft charge, WHEN IT HAS NEVER EVEN HAD A HEARING IN COURT. I AM JUST GUILTY! IT’S CRAZY!
    And I paid $500 cash that was all I had to scrounge up….just to bond out of jail that day, when I NEVER STOLE ANYTHING. I FELL BEHIND ON MY CAR PAYMENTS BECAUSE OF IT! AND THESE PEOPLE HAVE NOT COME TO COURT! AND HERE COMES THE BEST PART:
    I was surrounded by cops in a different Walmart a few weeks later, because I needed some things only Walmart has, like a Straight Talk phone card for one! Anyway, these cops in a whole different county surrounded me and took me roughly once again of course….straight to a room where 2 loss prevention women were and they acted like I was some damn serial killing child molesting predator or something. THESE PEOPLE HAVE FOUND ME AS THEIR VICTIM IS ALL THEY HAVE DONE!!! And in this room, these women advise me that they noticed me on camera and said that I am BANNED FROM EVERY WALMART ON EARTH FOR LIFE! EXACTLY HOW THEY PUT IT! PLUS EVERY SAM’S CLUB, AND EVERY MURPHY’S WALMART FUEL STATION. ALL FOR LIFE!
    And they tell me to either sign the paper they have made up, or go to jail right then and there once again, but for trespassing this time! WHAT IS GOING ON HERE? I NEED HELP!!!

    Please add me to all of these lawsuits. I shop at Walmart all the time. Walmart is going to have to be alot more honest about their products. The mayo, cereabars, pain patches that fall off just about all the product. Thank you
