Janumet cancer lawsuitA Texas woman whose husband died from pancreatic cancer in July has filed a lawsuit blaming the type-2 diabetes drug Janumet for the causing the condition that cost him his life.

William Kryzak of Texas was diagnosed with pancreatic cancer in September 2012. For two years prior to this diagnosis, William was prescribed and taking Janumet, according to a Janumet pancreatic cancer lawsuit filed by his wife. Just months before his diagnosis of pancreatic cancer, Kryzak quit taking Janumet.

He died in July. His wife, Paula, filed the Janumet lawsuit alleging his wrongful death.

Kryzak’s Janumet pancreatic cancer lawsuit has joined thousands of other type-2 diabetes drug lawsuits in a type of coordinated group lawsuit called a multidistrict litigation, or MDL. In MDLs, a group of lawsuits with similar allegations are tried together under one judge. Other type-2 diabetes medications alleged to cause pancreatic cancer after prolonged use include Victoza, Byetta, and Januvia.

All of the type-2 diabetes medications fall under a category of drugs known as incretin mimetics. Medical studies such as pre-clinical trials performed by Merck before its market approval of Janumet allegedly show evidence of patients being at an increased risk of developing pancreatic cancer.

Despite these pre-clinical studies, there are no warning labels on Janumet informing patients of these increased risks.

The multidistrict litigation, created because of the volume of Janumet lawsuits, indicates a strong possibility that a Janumet class action lawsuit will be formed. With a Janumet class action lawsuit, a group of plaintiffs with similar Janumet allegations can file a lawsuit on behalf of their group, or Class. Should any settlement be reached, the Class of affected victims share in the settlement with the attorneys being paid via a settlement fund. Since attorneys are only compensated upon a settlement, a Janumet class action lawsuit may be seen as advantageous for affected victims to consider.

In general, Janumet pancreatic cancer lawsuits are filed individually by each plaintiff and are not class actions.
