Consumers could receive payments from a $1.25 million Milwaukee bonded abrasive wheel settlement resolving claims that the tool company sold its products with inaccurate expiration dates.
The settlement benefits consumers who purchased bonded abrasive wheels sold under the Milwaukee brand between Jan. 1, 2017, and April 18, 2024.
According to the class action lawsuit, Milwaukee failed to properly disclose the expiration dates of its bonded abrasive wheels and the importance of these date codes. Consumers argue that they had no way of knowing that these products expired and could be dangerous if used past their expiration dates.
Milwaukee is a heavy-duty tool company that sells power tools to professionals and consumers.
Milwaukee hasn’t admitted any wrongdoing but agreed to pay up to $1.25 million as part of the bonded abrasive wheel class action settlement.
Under the settlement terms, consumers who purchased eligible bonded abrasive wheels can receive a payment based on the number of units they purchased. Claimants who cannot provide proof of purchase can receive up to $2.50 per purchased unit and claim up to eight units for a maximum payment of $20. Claimants with proof of purchase can claim an unlimited number of units and receive the total purchase amount for these units for a maximum payment of up to $100.
In addition to providing monetary benefits, Milwaukee agreed to make changes to its product packaging to include a date code. This date code and other added statements will reportedly improve the awareness and meaning of the product expiration dates.
The deadline for exclusion and objection is July 2, 2024.
The final approval hearing for the settlement is scheduled for Aug. 16, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by July 2, 2024.
