A $975,000 Discover Bank settlement resolves claims the bank denied Deferred Action for Childhood Arrivals (DACA) recipients loans despite them meeting lending requirements.
The Discover Bank settlement benefits recipients of valid and unexpired DACA status who applied for credit from Discover’s student, personal or home loan credit lines between July 22, 2018, and Feb. 29, 2024, and were declined credit or only received credit after meeting Discover’s requirement to have a U.S. citizen or lawful permanent resident as a cosigner.
According to the class action lawsuit, Discover Bank discriminated against DACA recipients by denying them student, personal and home loans. Plaintiffs in the case argue Discover imposed “unequal conditions” on them based on their DACA status in violation of the Civil Rights Act.
Discover provides online banking, credit cards, personal loans, student loans and home loans.
Discover Bank hasn’t admitted any wrongdoing but agreed to a $975,000 settlement to resolve the DACA class action lawsuit.
Under the terms of the Discover Bank settlement, class members from California can receive up to $2,500. Non-Californian class members can receive up to $250. These payments may be increased or reduced on a pro rata basis depending on the number of claims filed, but no individual payment will exceed $16,000.
The deadline for exclusion and objection is July 11, 2024.
The final approval hearing for the Discover Bank settlement is scheduled for Aug. 30, 2024.
To receive a payment from the Discover Bank settlement, class members must submit a valid claim form by July 11, 2024.
