Toyota class action lawsuit overview:

  • Who: Plaintiff Teresa Solis is suing Toyota over its prepaid ToyotaCare Plus maintenance plan.
  • Why: Solis claims Toyota deceived her with “fraudulent and misleading representations,” leading her to pay $1,025 for a maintenance plan that she says is not worth the cost.

Toyota falsely advertises the value of its prepaid ToyotaCare Plus maintenance plan, misleading consumers into believing the plan will save them money, a Toyota class action lawsuit claims.

Plaintiff Teresa Solis alleges she was deceived by Toyota’s “fraudulent and misleading representations” when she paid $1,025 for the Toyota maintenance plan when she purchased a used RAV4 vehicle in October 2020. The plan was supposed to cover her vehicle up to 55,000 miles, the Toyota lawsuit says.

A salesperson allegedly told Solis the maintenance plan would cover 10 maintenance services that would occur every 5,000 miles and were collectively valued at $1,900. Therefore, Solis says she believed she would save at least $875 in costs by purchasing the plan.

Toyota maintenance plan not worth the cost, plaintiff says

Solis said when she brought her vehicle in for scheduled maintenance, she began to realize that certain maintenance was sometimes skipped or performed ahead of schedule. She also noticed that the dealership was billing Toyota for far less than the purported value of the service, according to the class action lawsuit.

For example, the plaintiff says she brought her vehicle in for a scheduled 20,000-mile regular service, but Toyota reportedly performed a major service that should not have been done until the car reached 30,000 miles.

Solis also claims the dealership billed Toyota approximately $200 less than the purported $400 value for a major service, and that she learned she would have only been billed $380 if she had paid with cash, still less than the purported $400 value.

The plaintiff says because Toyota performed services ahead of schedule, she ended up receiving far fewer services than she had purchased pursuant to the maintenance plan. She also realized she allegedly would have only paid $800 to $900 for all of the services if she had paid cash for all the services.

Solis filed the Toyota lawsuit on behalf of herself, a proposed nationwide class and a California subclass of consumers who bought a Toyota maintenance plan within 90 days of purchasing a vehicle from the defendants.

The Toyota class action lawsuit asserts claims for unjust enrichment, fraud, negligent misrepresentation, breach of contract and other violations.

Toyota Motor Credit Corp. recently agreed to pay $60 million to settle allegations it sold vehicle loan add-ons and prevented refunds from borrowers who attempted to cancel the add-ons.

    Toyota sold my car without notifying me when i took it a nto the dealership for service and I never saw my car again. I wish I could get a lawyer strong enough to sue Toyota.

    I bought a new Toyota highlighner in 2019, I bought the extra protection plan , but never benefited from it, simply because every time I need it, dealerships said it’s not included!!! At around 38000 miles, dealership recommended new tires, plan said,it’s not included, once I drove over a small metal rod,that damaged my rear tire, dealership said not included what a waste of money. My monthly payment is $450 a month, dealership convinced me when the car was purchased that for $20 a month extra, I can have all these things covered, so now I pay $470 a month. I have around $5000 to pay it off. But definitely it was a mistake buying this extra coverage.

    i have the Toyota Highlander that was purchased brand new on September 2012.I have the same problem with the complainant that purchased the Toyota Maintenance Plan.It didn’t work on what they promised and spend alot of money on my own pocket.What they promised didn’t materialize in the Plan.

    I purchased the coverage on my 2020 RAV4 that ended up totaled at the end of 2021. Not sure what happened to the coverage. We purchased the coverage again for our replacement vehicle, a 2019 RAV4. My understanding is that they did not cover my tires or battery so far. I will need to look into the scheduled maintenances to see if anything seems off.

      I purchased my certified used 2021 RAV4 Hybrid and bought the toyotacare package and the very first time I used it they did not change my oild as the app stated they should have and As I requestes them to. They told me it wasnt needed. Then the 2nd time I used it they tried to say I needed 2 tires in the front replaced but that was impossible because one of the tires was new that I purchased from a different place. They were shocked and tried ro make an excuse.

    I was told that I would have bumper-to-bumper coverage, but when I have phones with my tires, they did not help

    If there is a lawyer reading this. A class action lawsuit needs to be brought again Nissan as well. They are also guilty of selling bogus warranties.

      Paid additional money for extended warranty on a Toyota 3024 crown and don’t think it was necessary. They made me believe I needed the coverage

    I did purchase one. Whenever I’ve had an issue it’s like pulling teeth from them. And sometimes they say, it’s not covered. Even though the sales person said bumper to bumper coverage

      I purchased the maintenance plan and the Toyota care plan in addition to the extended warranty. I was told multiple time that my issues weren’t covered when I would go to the dealership but when I would call the warranty company they said it was covered but Toyota would have to call them. I was unable to be reimbursed for any of my services due to Toyota refusing to call to put in a claim. This left with out of pocket over $2,000 total. I had a crack in my windshield that should have been covered I payed over $500 each time to get it fixed. I had a mail in my tire that Toyota claimed wasn’t covered and I had to replace the whole tire- this happened twice. But in my ToyoGuard Toyota Care brochure I received it clearly says it’s covered.
