COVID vaccine exceptions class action lawsuit overview: 

  • Who: Bernice Conley filed a class action lawsuit against President Joseph R. Biden and U.S. Attorney General Merrick Garland. 
  • Why: Conley claims Biden violated the civil rights of federal employees forced to abide by his COVID-19 vaccine mandate to keep their jobs at the United States Customs and Border Protection. 
  • Where: The class action lawsuit was filed in California federal court. 

President Joe Biden violated the civil rights, civil liberties, health and wellbeing of federal employees whom he mandated must take the COVID-19 vaccine, a new class action lawsuit alleges. 

Plaintiff Bernice Conley claims approximately 33,000 federal employees were forced to “inject their persons with a novel vaccine through coercive means” after Biden signed an executive order that put the mandate in place. 

Conley argues religious and medical exceptions introduced as a possibility with the mandate were not honored, meaning an employee had 14 days to receive their first vaccination dose. 

“Failure to comply with the mandate resulted in discipline, which included removal from the federal service,”  the COVID-19 vaccine class action states. 

Conley claims federal supervisors who “refused to comply” with the vaccine mandate were also “subject to discipline for insubordination and up to removal from the federal service.”

COVID-19 vaccine mandate should be ‘abrogated,’ class action says

“This mandate infringes on the People’s individual freedoms of Life, Liberty and Property and should be abrogated in order to preserve the basic principles that our founding fathers relied on when drafting the constitution,” the COVID-19 vaccine class action states. 

Conley wants to represent a class of United State Customs and Border Protection who were subjected to the COVID-19 vaccine mandate signed by Biden and enforced by Attorney General Merrick Garland.

Conley claims Biden and Garland are guilty of negligent misrepresentation and intentional infliction of emotional distress and in violation of the Fair Employment and Housing Act, among other things. 

She demands a jury trial and requests injunctive relief along with an award of general damages for herself and all class members. 

In September, a judge granted class action status and a preliminary injunction to a group of U.S. Marines arguing against abiding by a COVID vaccine mandate put in place by the Department of Defense.

    I was a federal employee and was told I would be terminated if I did not get vaccinated by January 1st of 2023. One of the perks with government employment is you can keep your health insurance when you retire. I was still 3 years away from my preferred retirement and didn’t want to loose my job. I called HR and asked about termination and if it was possible to keep my health benefits if that happened. HR told me that I could not keep my health benefits if terminated so I applied for an emergency retirement. Turns out that HR lied to me and health benefits can continue even if terminated. Retirement for most people is a joyous time, mine was stressful. So unfair.

    I was told if I didn’t take the vaccine I would lose my job as a federal employee. My religious exemption was never granted and I had to get tested twice a week. I was an essential worker and was forced to wear a mask while vaccinated employees did not have to wear a mask. I quit my job because I was not going to get that vaccine. I am a retired disabled veteran who served my country for 21 years and I was not going to be forced to take the vaccine. I should not have been put under pressure or duress to take a vaccine or lose my job and benefits

    My name is Khemet Osborne, I was wrongfully separated from the U.S. Army after serving nearly 7 years. I had another 3 years of service left on my contract and was forced out because I refused an experimental vaccine.

    I was a chief in the USN for 14 years. But I was Discharged due to my religious exemption request coming back denied. Retirement, health benefits gone due to an unjustly system.

    Me gustaria saber si se puede tomar acciones legales por efectos sevundarios por ponerme la va una. Despues que me pusieron la vacuna me diagnostucaron. Con Artritis Reumatoide el cual me causa una inflamacion cronica en todo el cuerpo a tal punto que se me hace dificil de levantarme en muchas de las ocaciones. Ayuda por favor aveces no puedo levantarme y mucho menos trabajar y me afecta financieramente, emocional, y en todos los aspectos.

    On December 2021, I was terminated from my job due to my decision to decline vaccination. Unfortunately, I was not eligible to receive unemployment benefits.

    Is there a class action lawsuit for the people who did not want to take the experimental shot but was forced to take it or lose their job ? At the time I was employed for about 16 years and did not want the shot but was told if I didn’t get it I would lose my job and the day I took the second one they canceled the deadline. I feel like we were tricked into taking it and I have not felt right since I got it.

      Many of us were forced to have the vaccine or lose our jobs now the policy has been terminated and new employees are not required to be vaccinated. Is there any legal recourse to this.

    I WAS FORCED TO VACCINATE IF I WANTED TO APPLY FOR PERMANENT RESIDENT CARD IN THE UNITED STATES. IF I DIDN’T, I WAS GOING TO BE IN DANGER OF BEING DEPORTED FROM THE UNITED STATES. I FEEL I SHOULD HAVE NOT BEEN FORCED, ESPECIALLY WHEN THE FEDERAL GOVERMNT KNEW THIS VACCINE WAS GOING TO PUT MY HEALTH IN DANGER. I WOULD LIKE TO SPEAK TO SOMEONE OR ATTORNEY THAT CAN BETTER ADVICE ME IF THERE IS A LEGAL WAIT TO SUE THE FEDERAL GOVERNMENT,
