COVID vaccine exceptions class action lawsuit overview: 

  • Who: Bernice Conley filed a class action lawsuit against President Joseph R. Biden and U.S. Attorney General Merrick Garland. 
  • Why: Conley claims Biden violated the civil rights of federal employees forced to abide by his COVID-19 vaccine mandate to keep their jobs at the United States Customs and Border Protection. 
  • Where: The class action lawsuit was filed in California federal court. 

President Joe Biden violated the civil rights, civil liberties, health and wellbeing of federal employees whom he mandated must take the COVID-19 vaccine, a new class action lawsuit alleges. 

Plaintiff Bernice Conley claims approximately 33,000 federal employees were forced to “inject their persons with a novel vaccine through coercive means” after Biden signed an executive order that put the mandate in place. 

Conley argues religious and medical exceptions introduced as a possibility with the mandate were not honored, meaning an employee had 14 days to receive their first vaccination dose. 

“Failure to comply with the mandate resulted in discipline, which included removal from the federal service,”  the COVID-19 vaccine class action states. 

Conley claims federal supervisors who “refused to comply” with the vaccine mandate were also “subject to discipline for insubordination and up to removal from the federal service.”

COVID-19 vaccine mandate should be ‘abrogated,’ class action says

“This mandate infringes on the People’s individual freedoms of Life, Liberty and Property and should be abrogated in order to preserve the basic principles that our founding fathers relied on when drafting the constitution,” the COVID-19 vaccine class action states. 

Conley wants to represent a class of United State Customs and Border Protection who were subjected to the COVID-19 vaccine mandate signed by Biden and enforced by Attorney General Merrick Garland.

Conley claims Biden and Garland are guilty of negligent misrepresentation and intentional infliction of emotional distress and in violation of the Fair Employment and Housing Act, among other things. 

She demands a jury trial and requests injunctive relief along with an award of general damages for herself and all class members. 

In September, a judge granted class action status and a preliminary injunction to a group of U.S. Marines arguing against abiding by a COVID vaccine mandate put in place by the Department of Defense.

    I gave in and got the J&J vaccine because I couldn’t afford to lose my job. I have had severe headaches almost every day since. I am going to get a CT of the brain soon to see if there are clots. I wish I could sue the responsible parties for all of it. Anyone know of a class action for my case?

    I was employed by the Federal Government as an attorney for the Small Business Administration. I had worked 100% from home (Arizona), reporting to an SBA office located in Texas, from day one. I never came in personal contact with a single employee of the federal government or the SBA during my tenure as an attorney. I performed 100% of my job duties from my home. On January 20, 2022, I was terminated for failing to secure a Covid-19 vaccination. The following day, a district court in Texas issued an injuction enjoining the very same action that happened to me. It is my understating the the 5th Circuit recently upheld the validity of that injunction. I was never again contacted by the SBA after my termination. I am 62 years old and have been unable to secure similar employment, perhaps due to ageism. I would be interested in visiting with anyone who may be help to offer advice or legal assistance.

      Hello. I am in the same identical situation for a private employer. 100% removed hired over zoom. Never met with anyone from the company. Fired November 2021

    As a federal employee at a 3-letter agency, I was ordered to take 2 shots (moderna) and even though I had an reaction to first shot, ordered to take 2nd shot or get fired. So, I took 2nd and I am now paralized on the right side of my face. No known cure. I was intimidated and threatened. All this and I worked all through the lockdown at my regular workplace. The government paid people to stay home for free (not charged leave) for 18 months but would not pay me for my time off due to medical appointments or the fact that I had to change my whole way of living (ie learning to drive with one eye or learning how often to reach up and push my eyelid down to keep my eye moist). Blackmailed by Biden and his communist policies (Forcing all of us to be experimental rats)

    I was a work from home employee that was fired because of a COVID vaccine mandate. I worked there for nearly ten years and was never fired for not taking the flu vaccine. We were told that this new mandate was to protect patients. But I worked from home, live alone, and was quarantined. I posed no ‘safety threat’ to anyone. Employer also had a ‘mask mandate’ but chose only to enforce the ‘vaccine mandate’ on its work from home employees. Both mandates had absolutely NO effect on patient safety when enforced on 100% work from home employees.

    My husband is a RN in Oregon, and was forced to get the vaccine. His medical exception was denied and had to get main and booster to keep his job. I lost my job because I refused to take the vaccine, my medical exception was too denied.
    Would love to be part of the class action suit. please let me know how we can be part of this

    As a civilian Federal emplyee of DOD for 25 years this mandate has been very life changing.. i refused the vaccine along with about 10 percent of our Army workforce. Im interested in class action litigation or info which can be obtained regarding this mandate . The last three years has been tough to say the least

    Im very proud of those who have stood their ground and fought for what is ” right” thank you.

    I worked for the theater’s in Pittsburgh Pa, Pittsburgh Cultural Trust.. they made our outside contractor ABM industries a cleaning company enforce the vaccine and my sister and I refused to take the vaccine and lost our jobs we were there for 7 years and now they lifted the vaccination mandate for outside contractors and they still refuse to give our jobs back we would like to at least get our jobs back. They just keep us as xtras and we just get ran around. We are in the union and they won’t even help us fight for our rights. We would like justice for this is unconstitutional please if you can help us!

    I worked as a receptionist for a Methadone clinic for 4 1/2 years (2017-2022) When the pandemic took effect I was still undergoing chemotherapy & mandated to return back to work, or my job would not be secured. .Upon returning in 2020, I was soon mandated to test weekly. I tested weekly for a year due to religious exemption. Unfortunately I was advised to get vaccinated or I would lose my job, they would no longer honor my religious exemption. I was the device by my manager at the ti’m to request to be transferred to corporate, ( where they do not physically interact with clients, because there was an opening,, although when I suggested it, I was told there were no openings. Even with a religious exemption, I was denied unemployment benefits. It’s been a nightmare.

    My fiancé was a frontline nurse in the midst of surges and was fired and had his approved exemption revoked and was fired. No accommodations, transfer or any resolution. Fired after 22 years loyal work to Kaiser. You can imagine the psychological distress that has occurred as a result. It isn’t right and no one should have been forced to take an involuntary injection to their bodies. For all of us who did take the injection we have our own affects on our body that the government doesn’t care about. How can we join the lawsuit?

    I work as a social worker. My professional ethics code states I am to “promote self determination” and to advocate for “social justice for all.” In my role as social worker with a Public Health facility, I witnessed people lining up for jabs who were not properly informed prior to receiving vaccines. They were either clearly in active psychosis (had not been receiving medication for mental health issues) or were high on substances or alcohol. They showed up for the “free grocery vouchers” that the State Governor had offered as “reward” for receiving the jab, and therefore were co erced into taking the jab. (As evidenced by the fact that many turned up more than twice for the shots in order to receive more than one free grocery voucher, and were turned away). I was also linking a homeless veteran with a homeless shelter and the shelter intake representative asked me if the individual was vaccinated. I told her I could not respond as it was a violation of HIPAA laws and asked if he would be discriminated against and turned away if unvaccinated. The person stuttered and fumbled and was unable to give me a clear answer. I spoke out about these issues within my organization, (in line with my professional ethics code), and my arguments were dismissed and I was told I was “misinformed.” When I was required to have the vaccine, I was told my exemption from my acupuncturist would not be accepted. I have been diagnosed with an immune disorder and had had success with acupuncture and herbal treatments from an acupuncturist, which saw me symptom free within three months. My doctor, on the other hand, had told me my condition was “incurable.” After the work mandated flu shot I received, I had a reaction that created stiff shoulder and was unable to move my arm for three months. My acupuncturist advised me against having the MRNA vaccine due to the reaction I had experienced from this flu shot. Because my work refused to accept an exemption from my acupuncturist (who had been treating me for over two years), and because my work refused to accept my advocacy for clients who I witnessed being co erced into taking a shot (when they were either psychotic or altered by substances they had taken), and for those who I felt were being discriminated against due to their vaccine status, I resigned. I could not in all good conscience practice my profession and adhere to my code of professional ethics while working there. I also applied for another social work job with another non profit organization that insisted that if I was not to take the vaccine, I be tested weekly and pay for my own testing (95 dollars per week). I was to take unpaid time out from work to do this testing, and would not be re imbursed for the travel to and from the test site, and it was a test site of the non profit agency’s choosing. The job was a low paying one of 16 dollars per hour. Why did I spend so much money and study at college to end up in a profession where I am unable to practice my code of professional ethics? Why is this medical discrimination allowed to continue in workplaces that pride themselves on being “champions of diversity” and promote “equality”? The National American Social Work board also need to be taken to task for their very obvious democratic party bias (they are supposed to be politically neutral), and for working against the very code of Professional ethics they purport to uphold.
