COVID vaccine exceptions class action lawsuit overview: 

  • Who: Bernice Conley filed a class action lawsuit against President Joseph R. Biden and U.S. Attorney General Merrick Garland. 
  • Why: Conley claims Biden violated the civil rights of federal employees forced to abide by his COVID-19 vaccine mandate to keep their jobs at the United States Customs and Border Protection. 
  • Where: The class action lawsuit was filed in California federal court. 

President Joe Biden violated the civil rights, civil liberties, health and wellbeing of federal employees whom he mandated must take the COVID-19 vaccine, a new class action lawsuit alleges. 

Plaintiff Bernice Conley claims approximately 33,000 federal employees were forced to “inject their persons with a novel vaccine through coercive means” after Biden signed an executive order that put the mandate in place. 

Conley argues religious and medical exceptions introduced as a possibility with the mandate were not honored, meaning an employee had 14 days to receive their first vaccination dose. 

“Failure to comply with the mandate resulted in discipline, which included removal from the federal service,”  the COVID-19 vaccine class action states. 

Conley claims federal supervisors who “refused to comply” with the vaccine mandate were also “subject to discipline for insubordination and up to removal from the federal service.”

COVID-19 vaccine mandate should be ‘abrogated,’ class action says

“This mandate infringes on the People’s individual freedoms of Life, Liberty and Property and should be abrogated in order to preserve the basic principles that our founding fathers relied on when drafting the constitution,” the COVID-19 vaccine class action states. 

Conley wants to represent a class of United State Customs and Border Protection who were subjected to the COVID-19 vaccine mandate signed by Biden and enforced by Attorney General Merrick Garland.

Conley claims Biden and Garland are guilty of negligent misrepresentation and intentional infliction of emotional distress and in violation of the Fair Employment and Housing Act, among other things. 

She demands a jury trial and requests injunctive relief along with an award of general damages for herself and all class members. 

In September, a judge granted class action status and a preliminary injunction to a group of U.S. Marines arguing against abiding by a COVID vaccine mandate put in place by the Department of Defense.

    I work for the VA and not in a healthcare role and was forced to take the jab or be fired. I buckled too quickly and wished I hadn’t I know a few people who waited for their walking paperwork and came through it still employed. Wish I had the conviction they did.

    Mandated by a private nyc company to take the jab even tho worked remotely for over a year. Filed religious objections. Rejected. Filed medical objections. Rejected. Told I had to ‘resign’ and sign an Nda and would receive a nominal payment and unemployment $. I Refused. Laid off/fired and refused unemployment. Can I be included in class action?

    I’m a Federal employee (TSA/DHS).
    I was mandated to vaccinate or be separated from Federal employment. I did only to remain employed.

    I am an employee of NYPD. I applied for reasonable accommodation (medical) to be exempt from the vaccine mandate. I received a denial via email with no explanation and there was nobody that would return a phone call to speak to whoever denied my request. I received an email that I would be terminated in March 2022 if I did not get the first dose of the vaccine. I received the first dose and then the second dose in May 2022. Since then, the mandate has been lifted and I want to be compensated for what NYC and the government did.

    The California National Guard Adjutant General did not accept any religious or medical waivers, forcing me and many others to resign or retire, if eligible. This act cut my career short, and severely reduced my financial status with fewer career points towards my pension.

    I was fired from my job that never swabbed me I volunteered to do a weekly swab they denied my offer, I was also offered a transfer that never took place but they instead transferred other employees. I worked for Vpne parking solutions at the Brigham and women’s hospital in the garage they decided to deny my religious form because I expressed It was to soon to get vaccinated since not enough research was done on the vaccine at the time and they wouldn’t tell me what was in the vaccine and they wouldn’t answer when I asked if they would be there for me or my family if I had a adverse reaction, no hazard pay or workers compensation no unemployment, then they sent me a letter stating I quit when In reality they fired me (wrongful termination) I felt harassed and pressured and ganged up on. I may be replaceable to the company but I’m not replaceable to my family.

    I was employed by a large healthcare system which denied my religious exemption for the Covid 19 vaccination, resulting in my dismissal.

    I was fired by my employer because I would not get the vaccination based on a health condition and I had been working remotely for over two years and not in physical contact with anyone. I was granted unemployment by EDD but my company appealed it after I received the unemployment, I lost the appeal after being railroaded by a representative from Equifax, HR and the appeals Judge. One of the customers of Equifax is our own government.
