wyndham hotel and resortsWyndham Vacation Resorts has been hit with a class action lawsuit from customers who claim that their sales policies and practices regarding timeshares are deceptive.

Plaintiffs AnnaMarie Deneen, Michael J. Deneen, Erin Munoz, Paul Munoz, and Nazret Z. Gebremeskel say that Wyndham makes misrepresentations to customers about numerous features in their vacation plans, ranging from the value of timeshare points to the cleaning services that are available to the vacationers.

“Wyndham’s business model is premised on the false assumption that you can lie to consumers to get them to sign confusing, vague and ambiguous boilerplate contracts and that because then there is a purported written agreement, you have no liability for the lies,” the Wyndham class action lawsuit claims.

The Wyndham class action lawsuit states that the hotel chain has been penalized in the past for their deceptive sales practices from state governments, including a $20 million verdict in a case involving a whistleblower.  

For example, the plaintiffs state that in October 2003, the California Attorney General and the District Attorney in San Mateo sued the Trendwest (the predecessor of Wyndham) for unlawful sales practices and wound up settling for $4.3 million.

Also, in 2007, customers filed a class action against Wyndham, and the company agreed to cancel 22 million vacation credits and paid Class counsel up to $5 million in legal fees.

“After getting consumers to sign form contracts through deceptive sales practices, Wyndham then breaches its form contract entitled ‘Security Agreement – ClubWyndham Access Vacation Ownership Plan – Retail Installment Contract – Purchase and Security Agreement’ by not making destination accommodations available, by charging excessive fees not referenced in the contract, and by failing to provide promised ancillary services such as cleaning and housekeeping,” the Wyndham class action lawsuit claims.

The Wyndham timeshare model uses points, which are purchased by vacation goers, and can be used to stay at any Wyndham “or affiliated resort throughout the world.” 

The Wyndham class action lawsuit claims that desired destinations are not available at the desired time and need to be booked as much as a year beforehand.  

“The business practice of Wyndham is to focus on selling points, rather than managing the destinations and making them available to members. Wyndham members find that there is little availability. When they complain, Wyndham’s response is that they need to buy more points,” the Wyndham class action lawsuit alleges.

The plaintiffs also state that a sales pitch to purchase more points begins even before the vacation goer parks their car.  Before they are given a parking pass, they are urged to attend an owner meeting update, which is just a sales presentation for Wyndham to purchase more points.

The Wyndham class action lawsuit claims that if members are able to get parking passes without attending a sales meeting, they are harassed with phone calls and marketing materials are placed under their doors to attend more sales meetings.

“These meetings last most of a day and do not conform to most consumers’ idea of a ‘vacation day,’” states the class action lawsuit.

Putative Class Members in the Wyndham class action lawsuit include: “All persons who entered into a ‘Security Agreement – ClubWyndham Access Vacation Ownership Plan – Retail Installment Contract – Purchase and Security Agreement’ (Agreement) with Wyndham or its successors in the last ten years and whose Agreements do not contain arbitration clauses.”

The plaintiffs are represented by Howard B. Prossnitz of the Law Offices of Howard B. Prossnitz and Adam Szulczewksi.

The Wyndham Timeshare Class Action Lawsuit is Deneen, et al. v. Wyndham Vacation Resorts Inc., Case No. 1:19-cv-05499, in the U.S. District Court for the Northern District of Illinois.

    Wanting help getting out, we signed up with Wyndham in 2020, very nice salesman told us basics. We went to Vegas this year and they informed up being bought out by another company and went thru 5 hrs of an upsale. Basically informed us of new rules and things we could do to Take advantage of our points that was not told initially. By the end of the 5 painful hours both my wife and I were under assumption old vip was null and void and they were entering us into a new improved program with more perks, a few more points for a lil more money. My wife signed through documents then I stopped halfway thru mine after I found out they were selling us a second package! I got pissed and went off on sales people and told me to back out instantly! They basically almost sold us into a deal more than our house Mortgage!! I was so mad with the shady sales practices and art of confusion they used to make a mediocre contract look like a gold fortune! Any info to help me get out would be appreciated I am mad at Wyndham corporate and do not trust them anymore!

    have purchased times share package (member ID 00203732997 with Club Wyndham on 06/29/2021 at Wyndham Grand Desert Hotel in Las Vegas. I stepped into their office at that day hoping to receive an extension to my trial discovery package ( member ID 00203607903) purchased in 2019 but due to Corona virus was not used fully. That trial membership expired in two years. I was promised to possibly extend it when visited Wyndham personal at Wyndham Grand Desert. Instead I was offered rolling of my trial package with unused points into time share deal. I told them that I would not be able paying high premiums but they told that my premiums would be less than 200 per month. As I figured out later ( in a middle of July) my premiums are 335 dollars per month without APR included. I tried to call and cancel (but they declined my request because it was over 10 days since purchase). I spoke to Michelle. Her Wyndham ID 708581. I want to cancel that membership. I have not used it at all.
    The time share program that I am on called: Club Wyndham access points. Though I purchased it in Vegas, it is an access to any Wyndham location.
    They billed a down payment of 7147.15 dollars to the Credit Card. I tried to seek the help with a legal company who assist with cancellation of undesirable timeshares but they told me that they can’t cancel the third party payments ( in my case it is Barclays credit card). They could assist cancelling only the loan with Wyndham. That legal company commented that it is a trap that Wyndham used to prevent the cancellation of the membership. That is why I had to seek help with BBB.
    I also was told by Wyndham sales that with membership and VIP access that I have I can book resent and hotels easy when I tried to book with my membership new trip that was suppose to be at the end of August their customer care representative told that there no resorts in my destination ( Colorado Springs) and Wyndham hotels that are there can be booked only in two month in advance. So, I have limitations flexibility with extremely high monthly payments

    I’m definitely interested in this lawsuit. Please include me. Purchased in 2017 and told to wait one year before using the timeshare. Booked my first vacation 15 months later. The night before my arrival date my reservation was cancelled. I was told I cancelled it however I had a hard copy of my online verification. I’ve only used it once since 2017 and its now June 2021 however Wyndham has consistently taken fees and maintenance dues out of my account each month Wyndham has also conveniently changed my due date to suit their needs without consulting me. Now Wyndham offers of cash payments for the use of their Wyndham Resorts suites in lieu of points. Getting information is always a telephone tag game resulting in being given yet another referral telephone number to call and call and call. I was just told they couldn’t give me information until my account was paid off.

    After telling them that we didn’t want to buy anymore, she told us that oh no, we are not allowed to sell anything during the pandemic. Lies, We walked out of there with no papers but received the contract by e-mail weeks later with over $13000 selling us points which we didnt want or needed we are approaching 80 yrs old and I have a muscle disease and hard to walk or get around

    To my USA community ❤….
    It’s been a few years Wyndham has led me to believe they would resolve the fraud through there Wyndham buyback program process…? Bullshiet…
    I am now reporting this fraudulent company Wyndham to the attorney General’s office…I suggest to everyone to do the same…we can not let anymore fraud against our seniors and community trying to make dreams come true for there families are being attacked by Wyndham this is abuse at the highest level and needs to be nipped in the bud.
    Please report them as fraud in their lies at tbe sales presentation and locking people into slaves!!!!

    Did anyone on here actually settle with Wyndham and have a good experience? asking to see if they are trying to scam me again with their settlement offer. They did notask me to buy any more points, btw.

      They always ask you to buy more points. And they will say anything to try and convince you to do so – it’s how they make their money. They are expert sales people and have tried many tactics on us and we have caught them in lies. Just this week at the corporate office in Myrtle Beach we met with a sales rep after we were told that they can’t sell points out of their corporate office. Guess what? They tried to sell up 154,000 more points for “only” $35,000! We said why has it gone up, it was $30,000 last week. The director from Egypt replied “that was a different product”. We looked at the fine print it was the same product, just 154,000 more points! The sales rep went to ask another director and he admitted it was the same product, but pricing had gone up this week. So many lies at each presentation, we have lost track! Sad, because we actually contacted corporate to try and figure this thing out. Our conclusion: it’s a bunch of lies to sell you more points!!!!
