woman applying younique mascaraCustomers have requested approval of a $3.25 million settlement deal that would end class action claims that Younique mascara is not made from natural fibers as advertised.

Under the terms of the proposed class action settlement, consumers in 11 states who purchased “Moodstruck 3D Fiber Lashes” between 2012 and 2015 will benefit from this settlement.

Class attorneys are seeking expenses of $175,000 and about $1 million in fees. The amount that each Class Member could receive under the proposed deal has not yet been made available.

A preliminary approval hearing of the Younique class action settlement has been set for Sept. 16, 2019.

The Younique natural fibers class action lawsuit was filed by Megan Schmitt in 2017, who was later joined by other Younique customers.

The plaintiffs claimed that Younique falsely advertised its Moodstruck 3D Fiber Lashes mascara as being made of “100 percent green tea fibers,” when really, the mascara consisted of shredded nylon fibers, not green tea.

The consumers alleged that the company intentionally misled them about the nature of the mascara, and profited from the deception. Customers say that they were financially injured by Younique because had they known that the mascara was made from nylon, not green tea, they would not have purchased the mascara or would not have paid as much for it as they did.

In addition to a monetary payout, Younique has agreed to have any product described as “natural” tested by a reliable laboratory every six months, a requirement that will be upheld for the next three years if the settlement deal is approved.

Younique has not admitted liability in the mascara labeling class action lawsuit, but has agreed to settle the claims to avoid the potential risks and costs of continuing litigation.

Though customers have agreed to settle their Moodstruck mascara natural fibers class action lawsuit, they say that they had “built a strong case for liability and damages,” nonetheless. They believe there is “ample evidence that the fibers were not ‘natural.’”

This is not the first Moodstruck natural fibers false advertising class action lawsuit that Younique has faced. In October last year, consumers filed another such Younique class action lawsuit in Missouri state court. The consumers in the second Younique class action lawsuit have not yet received Class certification.
