Multiple class action lawsuits have recently been filed against companies accused of violating the Telephone Consumer Protection Act (TCPA) by sending consumers unsolicited marketing text messages and calls.
The TCPA mandates that no person or entity is allowed to send unsolicited texts to cell phones, make calls or texts to numbers on the National Do Not Call Registry, or make unsolicited calls to residential or cell phones using an automated dialing system or pre-recorded messages.
Zillow sent consumers unwanted marketing texts and calls, says class action
A class action lawsuit was filed against Zillow Group Inc. last month over claims the real estate company sent consumers unwanted marketing texts and calls, in violation of the TCPA.
Zillow is accused of contacting consumers who have specifically asked not to be contacted by the company, in addition to individuals with numbers listed on the National Do Not Call Registry (DNC).
Keller Williams contacted consumers with unsolicited automated marketing calls and texts, says class action
A class action lawsuit was filed against Keller Williams earlier this month by a consumer arguing the real estate company repeatedly contacted consumers with unsolicited automated marketing calls and texts.
Keller Williams and its agent Britney Gaitan are accused of repeatedly sending marketing calls and texts even to numbers that are listed on the National Do Not Call Registry, in an alleged violation of the TCPA.
“As taught and instructed by Keller Williams, with the tools provided by Keller Williams, Gaitan began making unsolicited prerecorded calls and sending unsolicited text messages,” the Keller Williams class action states.
New York & Company accused of sending promotional texts to consumers who had attempted to opt out
A class action lawsuit was filed against New York & Company by a consumer arguing the retail company continued to send them promotional text messages even after they attempted to opt out of receiving them.
The consumer claims New York & Company continue to send them promotional text messages even after they sent three written requests to the company asking for them to stop sending him the communications.
Rocket Mortgage sent unsolicited text messages to numbers on the National Do Not Call Registry, says class action
A class action lawsuit was filed against Rocket Mortgage earlier this month by a consumer arguing the mortgage company repeatedly sent unsolicited text messages to numbers listed on the National Do Not Call Registry.
Rocket Mortgage is accused of continuing to send unsolicited text messages even after the consumer behind the complaint — whose number is listed on the National Do Not Call Registry — argues they attempted to opt out of receiving them.
Palm Beach Tan accused of sending unsolicited sales texts to numbers on the National Do Not Call Registry
A class action lawsuit was filed against Palm Beach Tan earlier this month over claims the tanning salon company sent unsolicited sales text messages to numbers on the National Do Not Call Registry.
Palm Beach Tan is also accused of sending unsolicited text messages to individuals who had attempted to opt out of receiving them, in violation of the TCPA.
The consumer behind the complaint argues they replied “stop” several times to unsolicited sales text messages sent by Palm Beach Tan to no avail, that their privacy was invaded, and that their phone storage, battery life, and data was used.
TCPA claims lead to settlements with DirecTV, Shark Bar, Angel Rock Bar, Build-A-Bear Workshop
In addition to class action lawsuits, several settlement agreements have recently been made to resolve claims revolving around the TCPA and unsolicited calls and texts.
DirecTV agreed to pay $16.85 million earlier this month to put to bed allegations the cable and internet service provider violated the TCPA by placing unsolicited phone calls to individuals with numbers on the National Do Not Call Registry.
The operators of Kansas City, Missouri establishments’ Shark Bar and Angel Rock Bar agreed to a class action settlement last month, meanwhile, that ended claims they violated the TCPA by contacting consumers with unsolicited spam texts.
Also in May, Build-A-Bear Workshop agreed to pay $4.1 million to resolve claims the company violated the TCPA by placing unsolicited text messages to consumers after they revoked their consent to receiving them.

I STILL receive calls (& my husband does as well) from Rocket Mortgage at least every other week. This has been going on for well over a year, but it’s never the same person (for either of us), and they constantly claim that they are unaware that we have previously asked to be removed from the list.
