donald trump president twitter page on smartphoneA class action lawsuit claims that Donald J. Trump for President Inc., Trump’s reelection campaign, violated the Telephone Consumer Protection Act by contacting individuals via text message without their consent.

The Trump campaign text message class action lawsuit was filed by Dan Pederson, Connor Olson, and Shell Wheeler who say they each received text messages from the Trump for President campaign.

Wheeler and Olson state that in October 2019 they received a text advertising the Trump rally that took place in Minneapolis. Allegedly, the message read “Pres. Trump here. I want to see YOU Thursday, Oct. 10th at 7PM CDT at a HISTORIC rally in Minneapolis, MN. To claim your free tickets, RSVP here!”

Wheeler and Olson say that when they clicked on a link provided in the message, they were directed to the Donald J. Trump campaign page.

Pederson claims that he received a different message from the Trump campaign in October 2019. Allegedly, the message he received said “Enough hearings. Enough investigations. Let Rep. Craig know you stand with President Trump right now at 202-831-3386.”

The three text messages recipients say they have no affiliation with the Trump campaign, and did not give their express consent to receive such messages.

The Trump spam text class action lawsuit says that the Trump For President committee regularly sends text messages to cell phones without users’ consent, in violation of the Telephone Consumer Protection Act.

Pederson and others note that the TCPA prohibits businesses from sending spam text messages to individuals without their consent. The recipients explain that the TCPA prohibits the use of autodialers to place calls or send text messages without the prior consent of the party, or in the case of an emergency.

The Trump spam text class action lawsuit says that the messages sent to Pederson, Olson, and Wheeler were from an autodialer. The three recipients note that the text messages were sent from a 10 digit phone number, but calling the number resulted in an error message. The Trump for President class action lawsuit alleges that this indicates that the message did not originate from cellular phones, but from an automatic dialing system.

The text messages recipients say that they and other people were cased harm by the text messages, including aggravation, nuisance, and invasion of privacy. They also claim that the text messages wasted a quantifiable amount of data on their cell phones, reducing storage capacity, temporarily reducing computing power, and application processing speed, among other quantifiable costs.
