- Why: Gielow claims Pandora violated biometric privacy laws with the way it captured and stored the biometric data of customers who used the virtual try-on feature on its website.

Pandora Jewelry unlawfully captures, possesses and/or retains the biometric data of its customers who use its websites’ virtual try-on tool to try on jewelry, a new class action lawsuit alleges.
Plaintiff Diane Gielow claims Pandora analyzes and captures the facial geometry of customers who use its “On me” feature to virtually try-on jewelry.
Gielow argues Pandora violates the Illinois Biometric Privacy Information Act (BIPA) by allegedly failing to obtain consent before collecting the biometric data, not providing a retention and deletion schedule for the data.
Pandora is also accused of violating BIPA by allegedly failing to obtain consent before disclosing or otherwise disseminating its customers biometric data.
Pandora accused of failing to obtain ‘adequate written consent’ before collecting biometric data
“Defendants failed to obtain adequate written consent from Plaintiff to collect, capture, or otherwise obtain Plaintiff’s biometric data,” the Pandora class action says.
Gielow wants to represent a class of Illinois residents who had their biometric data captured, collected, received or otherwise obtained or stored by Pandora.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for herself and all class members.
Fashion company Christian Dior sought the dismissal last month of a similar class action lawsuit accusing the company of violating biometric privacy law with the virtual try-on feature on its website.
