A California man filed a recent NRT unwanted call lawsuit, claiming that the real estate company violated the Telephone Consumer Protection Act by making unsolicited phone calls regarding his property.
NRT Unwanted Call Lawsuit
Jorge V. of California filed his lawsuit against NRT and Coldwell Banker Real Estate on April 11, 2019. According to Jorge, he has received several unsolicited phone calls from NRT despite his phone being registered with the National Do Not Call registry.
Coldwell Banker is a real estate company operating in 49 countries. NRT is one of Coldwell Banker’s branded brokerages and is the United States’ largest residential real estate brokerage company.
According to Jorge’s NRT unwanted call lawsuit, NRT realtors are trained to cold call consumers in order to advertise the company’s realty services. Allegedly, NRT may even make calls to consumers who have listed their properties for sale through other real estate services and had their listings expire without selling. Jorge claims that this practice is taught to NRT realtors and that he was a victim of it.
Jorge claims that he initially listed his number with the Do Not Call Registry on Feb. 8, 2010, in order to avoid receiving unsolicited and unwanted calls. After listing a property for sale several years later, he removed the property from the market on May 15, 2018.
Although Jorge claims that he never included his cell phone number with the listing, he received a phone call on May 26, 2018, from a realtor with NRT. According to Jorge, he continued to receive calls from NRT after his contract with his original realtor expired. Jorge claims that he received multiple calls between May 2018 and February 2019.
Despite telling the realtors associated with NRT that his number was registered with the Do Not Call list and that he did not want to hear from them, he continued to receive calls. Jorge believes that these calls were made using an autodialer, or a system that allows telemarketers and solicitors to make mass calls to consumers. Autodialers may be used by telemarketers to send annoying and harassing phone calls, voicemails, and text messages.
According to Jorge, the autodialed calls made by NRT caused him actual harm. He claims that he has never had a business relationship with the company and that his original property listing did not include his phone number because he did not want to be harassed by calls about the property. In addition to the nuisance, annoyance, and invasion of privacy caused by NRT’s calls, Jorge claims that these calls also interfered with his use and enjoyment of his cell phone.
Additionally, these calls may be illegal under the TCPA. The Telephone Consumer Protection Act prohibits solicitors from using autodialing systems to make calls to consumers without their explicit consent. The act also requires companies to abide by the National Do Not Call list and comply with consumers who revoke their consent to be contacted.
Consumers who have received unwanted phone calls or unsolicited text messages from Coldwell Banker or NRT regarding their property listings may be able to file a class action lawsuit against the companies. Unsolicited phone calls that violate the TCPA may be subject to fines of up to $1,500 for each violation, meaning that victims may be able to collect significant financial compensation for these intrusions.
