T-Mobile Data Breach Class Action Lawsuit Overview:

  • Who: T-Mobile has been hit with a new lawsuit following its massive August data breach.
  • What: The class action lawsuit, like a number that have already been filed, claims the company acted negligently with consumer data.

T-Mobile’s lax data security allowed for millions of customers’ social security numbers, phone numbers, names and addresses to be stolen and sold online for bitcoin, a new class action lawsuit alleges. 

Plaintiff Richard Halpern filed the class action complaint against T-Mobile USA, Inc. on Wednesday, alleging the August data breach affecting T-Mobile customers was caused by the telecommunications company. The class action is the latest in a string of class action lawsuits filed against the company.

“The Data Breach was a direct and proximate result of T-Mobile’s failure to implement and follow basic security procedures, Plaintiff’s and Class Members’ personally identifiable information is now in the hands of criminals,” the class action states.

The lawsuit stems from a data breach made public around Aug. 15 this year. 

According to the class action, T-Mobile’s data, which purports to include the personal identifiable information of over 100 million T-Mobile users, was put on a forum for sale for 6 Bitcoin, or approximately $270,000. 

“T-Mobile announced that it was continuing to investigate the breach but has confirmed that the breach has occurred, and the information is in the hands of bad actors,” the class action states.

The plaintiffs are suing for negligence and violations of the Washington Consumer Protection Act. They’re looking to represent anyone whose personal identifiable  information was compromised in the August data breach.

They’re seeking certification of the class action, damages, costs, fees and a jury trial. 

T-Mobile Hit With Multiple Class Action Lawsuits After August Data Breach

The new class actions join others previously filed by T-Mobile consumers that also allege negligence and call for damages for the consumers to mitigate the fallout of the breach.

On Sept. 2, T-Mobile was hit with two new class action lawsuits alleging negligence in regards to August’s large-scale data breach, while the CEO maintained that the company is taking “significant steps to enhance our approach to cybersecurity.”

    I received notice from the security dept app provided by T-Mobile that TMobile was breached and my ss#, password, email, and phone number are all on the dark web. Explains why I recieved ALL TYPES of scam calls. Very frustrating. Disappointed because we’ve been with TMobile since 2001. Smh
