San Juan Regional Medical Center (SJRMC) has agreed to settle claims that certain personal information was exposed in a data breach identified Sept. 8, 2020.

Class members include all individuals whose personal identifying information or health information was compromised in the Sept. 8, 2020, cyberattack. 

A subclass has been established, consisting of individuals who received a notice from San Juan Regional Medical Center that their personal information was exposed. 

Patients filed a class action lawsuit against San Juan Regional Medical Center asserting the healthcare provider did not do enough to protect patients’ data from exposure in the event of a data breach. San Juan Medical Center does not admit to any wrongdoing in response to these claims, but the healthcare provider has agreed to settle with plaintiffs in the interest of avoiding the costs and risks of continued litigation. The following patient information was potentially exposed in the breach:

  • Drivers license number
  • Passport number
  • Social Security number
  • Financial account number
  • Health information
  • Name
  • Date of birth
  • Other information

All class members are eligible to receive two years of free identity theft and credit-monitoring services. 

In addition to these benefits, all members of the subclass are eligible to receive compensation for losses related to the cyberattack, totaling $2,500 in compensation. Covered losses include the following:

  • Compensation for out-of-pocket expenses caused by the cyberattack
  • Compensation for fees for credit reports, credit monitoring, or other identity-theft insurance product purchased after the subclass member received notice of the cyberattack through Oct. 13, 2022
  • Compensation for demonstrated monetary losses related to the cyberattack, such as attorneys’ and accountants’ fees, and fees for credit-repair services
  • Compensation for lost time related to the cyberattack, compensated at a rate of $17.50 per hour, if at least one hour was spent dealing with the effects of the cyberattack

Class members who wish to object to or exclude themselves from the San Juan Regional Medical Center class action lawsuit settlement must do so by Jan. 9, 2022.

To receive class action settlement benefits from the SJRMC data breach, class members must file valid claims by Feb. 8, 2023.

Who’s Eligible

Class members include all individuals whose personal identifying information or health information was compromised in the Sept. 8, 2020, cyberattack. 

A subclass has been established, consisting of individuals who received a notice from San Juan Regional Medical Center that their personal information was exposed.

Potential Award

$2,500 plus credit monitoring

Proof of Purchase

Subclass members must submit documentation of their expenses. The required documentation varies by type of expense, but examples include receipts, phone bills or account statements reflecting purchases made for credit-monitoring services. Self-prepared documents, such as handwritten receipts, will not be accepted.
