Barnes & Noble website class action lawsuit overview: 

  • Who: Daniel Rodriguez filed a class action lawsuit against Barnes & Noble Inc. 
  • Why: Rodriguez claims Barnes & Noble violated the Americans with Disabilities Act by allegedly failing to make its website fully accessible to individuals who are blind or visually impaired. 
  • Where: The class action lawsuit was filed in New York federal court. 

Barnes & Noble failed to design and maintain its website so that it would be fully accessible for individuals who are blind or visually impaired, a new class action lawsuit alleges. 

Plaintiff Daniel Rodriguez, a legally blind man, claims Barnes & Noble violates the Americans with Disabilities Act (ADA) by allegedly not making its website fully accessible to blind and visually impaired individuals. 

Rodriguez argues the alleged denial of full access to its website is a denial of the goods and services offered on it. 

Barnes & Noble website not fully compatible with screen-reading software, says class action

Rodriguez claims the Barnes & Noble website contains access barriers that prevent it from being fully compatible with screen-reading software used by individuals who are blind or visually impaired to browse the internet.  

“Plaintiff was denied a shopping experience similar to that of a sighted individual due to the website’s lack of a variety of features and accommodations, which effectively barred Plaintiff from being able to determine what specific products were offered for sale,” the Barnes & Noble class action states 

Rodriguez wants to represent a nationwide class and New York subclass of individuals who are blind or visually impaired and who were denied access to the equal enjoyment of goods and services offered on Barnes & Noble’s website. 

He also accuses Barnes & Noble of violating New York City Human Rights Law

Rodriguez demands a jury trial and requests injunctive and declaratory relief along with an award of compensatory, statutory and punitive damages for himself and all class members.

Consumers filed a number of similar class action lawsuits this year against companies, including Gap and Lane Bryant, for failing to make their websites fully accessible to individuals who are blind or visually impaired.
