Ambulance billing company Comstar LLC is being sued by two people who say they used the service and then had their personal information exposed in a data breach.
Plaintiffs Robert Woltag and Michael Frechette filed the class action complaint against Comstar LLC in an Essex Superior Court in July, alleging negligence and unjust enrichment. The case was removed to a Boston federal court Sept. 16.
According to the lawsuit, Comstar failed to protect its networks from hackers, allowing criminals to access sensitive personal data held by the company.
Potential information accessed in the hack allegedly included Social Security numbers and health information, the lawsuit states.
Comstar delayed advising customers of breach, lawsuit alleges
Comstar disclosed in May that an unauthorized person had accessed its servers in March.
The plaintiffs allege that the billing company failed to safeguard its computer systems and then provided affected consumers with a delayed notice of the breach.
“As a result of this delayed response, plaintiffs and class members were unaware that their private information had been compromised and that they were, and continue to be, at significant risk of identity theft and various other forms of personal, social, and financial harm,” they say.
The company has not offered credit monitoring services or identity theft protection services for victims of the breach, but has urged people to “take steps to help protect your information should you feel it is appropriate to do so,” the plaintiffs state.
They said they had to spend hours reviewing their bank accounts to protect themselves from the cybercriminals in the wake of the attack.
The plaintiffs are looking to represent about 70,000 people impacted by the breach. They’re seeking damages, fees, costs and a jury trial.
The news comes as the U.S. Office of Personnel Management (OPM) and its contractor Peraton recently agreed to pay $63 million in relation to a settlement in a class action lawsuit.
