Cash App data breach overview:

  • Who: A Texas woman has filed a class action lawsuit against Block Inc and Cash App.
  • Why: The lawsuit alleges the companies were negligent, and allowed a data breach that saw consumers personal information leaked.
  • Where: The Cash App data breach was filed in a California federal court.

Cash App and its parent company were negligent in their data security measures, leading to a 2021 data breach that released the information of 8.2 million Cash App Investing customers, a new class action lawsuit alleges.

Plaintiff Amanda Gordon filed the class action lawsuit against Block Inc and Cash App Investing LLC Nov. 2 in a California federal court, alleging negligence and violations of consumer laws.

Cash App, which is owned by Block, is a mobile app that allows users to transfer money from one person to another. It also provides investing services which allows users to purchase stock and Bitcoin through its platform.

According to the lawsuit, due to Cash App and Block’s negligent security features the companies failed to properly secure and protect app users’ personal identifying information (PII).

“Defendants’ negligence has resulted in the exploitation and release of Cash App users’ PII,” the lawsuit states.

Cash App and Block should have known the security systems were deficient, lawsuit alleges

The alleged failure to take reasonable steps to safeguard consumer information led to a December 2021 data breach that resulted in the release of PII of 8.2 million current and former Cash App Investing customers, the lawsuit states.

Customers’ full names and brokerage account numbers, the value and holdings of brokerage portfolios, and trading activity were all exposed, Gordon says.

Cash App and Block should have known that their security measures, protocols, screening procedures, and systems were deficient, the lawsuit alleges.

“By and through Defendants’ negligence, they have caused financial losses and negative consequences and their negligence will continue to harm Class Members’ into the future,” the lawsuit alleges.

Gordon is looking to represent all current or former customers of the companies who had their PII compromised in the breach.

Gordon is suing for negligence, violation of California consumer laws, fraud, negligent misrepresentation, breach of contract, invasion of privacy and breach of fiduciary duty.

She is seeking certification of the class action, an order forcing Cash App to get a third-party security auditor and make security improvements, damages, fees, costs and a jury trial.

This is not the first class action to be filed against Block and Cash App after the data breach. In August, the pair were hit with a class action lawsuit alleging they failed to safeguard the information of their customers during a December 2021 data breach.

Greetings, My CashApp has been so mishandled that I had to create a new account providing a loophole measure. My funds were taken and I have not been refunded, respected or compensated in any way.

  2. Dominique D Baker says:

June 13th Cash app fraudulently took $985.45 from my account and claimed it was to update the same transaction purchase I made to Wal-Mart back on 4/8/23. I provided proof and disputed it. Cashapp said in 10 days they would follow up to replace my funds. I followed up and they were mad because I wouldn’t agree with their lied so one rep hung up on me. I called back the other rep said since I don’t believe them and threatening to sew he said now you get nothing back and I’m canceling the dispute. He canceled it and they refused to allow me to speak with management. I have 6 kids and need my funds to cover bills and their needs. I am so stressed and angry.

Please add me to the lawsuit. I have all receipts, emails and screenshots.

    Thanks
    Dominique Baker

Someone I know was scammed on May 14, 2023 and Cash App refused to stop the scammer. Cash App is the problem. I am assisting with the manner and would like for the person that I know to receive justice and to be included in this class action.

My account seems to have closed for no apparent reason. All I got was I violated the terms of service. I bearily use cash app as it is, and I only use it to send and recieve money to my friends (who also use cash app) and use that money to buy food or pay a bill or someting. Is it against their terms of service to use ths app/service as intended? Is it hard to identify exactly what part of the terms of service I violated? Im a little befuddled on how the alledged violation is a secret to me the consumer/ account holder. Chatted with customer support and was told all they have is terms of service violation. I asked if they could point me to someone who coulx be more specific. They give me a number that tells you “we will give you a call back”. Who has time for all that? Why do I want to guess when customer service from cash app is going to call me ? How do I determine if it is, or isnt a spam call (I get a lot of those daily). Sounds like cash app is doing damage control, but lack of information, and failure to provide details on what part of the terms of service agreement has been violated, then having to call customer service after chatting with them to get told by an automated voice system that they will call you back is not acceptable. By the way this is my second account that has been closed for an undisclosed reason. Update I have recieved a call back from support, and was told basically the same thing (that they had no information as to what part of the terms of service I violated). I asked who could tell me and the rep told me that they would all say the same thing. I asked exactly whos decision was it to close the account, because they should know exactly what part of the terms of service I violated, because there should be no reason to close an account for no reason. The CR said his closing remarks to close the call and hung up on me.
