Cash App data breach overview: 

  • Who: A Texas woman has filed a class action lawsuit against Block Inc and Cash App.
  • Why: The lawsuit alleges the companies were negligent, and allowed a data breach that saw consumers personal information leaked.
  • Where: The Cash App data breach was filed in a California federal court.

Cash App and its parent company were negligent in their data security measures, leading to a 2021 data breach that released the information of 8.2 million Cash App Investing customers, a new class action lawsuit alleges. 

Plaintiff Amanda Gordon filed the class action lawsuit against Block Inc and Cash App Investing LLC Nov. 2 in a California federal court, alleging negligence and violations of consumer laws.

Cash App, which is owned by Block, is a mobile app that allows users to transfer money from one person to another. It also provides investing services which allows users to purchase stock and Bitcoin through its platform.

According to the lawsuit, due to Cash App and Block’s negligent security features the companies failed to properly secure and protect app users’ personal identifying information (PII). 

“Defendants’ negligence has resulted in the exploitation and release of Cash App users’ PII,” the lawsuit states.

The alleged failure to take reasonable steps to safeguard consumer information led to a December 2021 data breach that resulted in the release of PII of 8.2 million current and former Cash App Investing customers, the lawsuit states.

Customers’ full names and brokerage account numbers, the value and holdings of brokerage portfolios, and trading activity were all exposed, Gordon says.

Cash App and Block should have known that their security measures, protocols, screening procedures, and systems were deficient, the lawsuit alleges. 

“By and through Defendants’ negligence, they have caused financial losses and negative consequences and their negligence will continue to harm Class Members’ into the future,” the lawsuit alleges.

Gordon is looking to represent all current or former customers of the companies who had their PII compromised in the breach.

Gordon is suing for negligence, violation of California consumer laws, fraud, negligent misrepresentation, breach of contract, invasion of privacy and breach of fiduciary duty.

She is seeking certification of the class action, an order forcing Cash App to get a third-party security auditor and make security improvements, damages, fees, costs and a jury trial.

This is not the first class action to be filed against Block and Cash App after the data breach. In August, the pair were hit with a class action lawsuit alleging they failed to safeguard the information of their customers during a December 2021 data breach.

    I was hacked for over $500 from my cash app account cash app representatives are aloof and do not care I would like to get to the bottom of this I’m on social security and that was over half my money that month and I did not eat pay bills or have utilities please add me to this class action lawsuit

    Yes add me. Hacked. However they got my data, cashapp was accessed remotely. Tried to take over $600 for a bookstore across the country, video games, and food I would never eat. Not at my age( patterns were petty college man unprofessional purchase attempts blocked at first. Game website was Japanese) I have no idea how to use those and have no need. Chatbot and Emailing agents Refuse to help disabled professional. Horrid customer service bots. Do not use these apps. Get your money out right away. Advocate right away with professional details and screenrecordings, timestamps, record all customer service attempts.

    On May 13, 2023, I sent a Civil Theft notification to Cash App/Block giving them the statutory time to return the unilaterally seized monies from my Credit Union account. As some above have stated, Cash App is seizing monies on behalf of the financial institution rather than the “customer” who they falsely claim made the complaint. In my situation, the parties had no complaint. Wells Fargo had a complaint about the sender. The monies were unilaterally seized from the recipient. I am in Florida but believe as some of you have stated this is going on elsewhere. Upon the passage of the thirty day requirement, I intend to sue for “civil theft” in Florida in June. Any Class Action attorney is welcome to contact me regarding this matter in the hopes of expanding this for other injured folks.

    CASH APP IS A FRAUD & THEY ARE STEALING PEOPLE MONEY!!!! THEY STOLE $249 OUT MY ACCOUNT SAYING THE MERCHANT TOOK IT & WHEN I CALLED WALMART , WALMART SAID CASH APP IS LIEING!!!! THEN THEY ARE SWITCHING THEIT WORDS AROUND!! NONE OF WHAT THEY ARE SAYING IS SHOWING ON MY STATEMENT ON CASH APP BUT IT SHOWS ON THEIRS!!!!!!!

    I literally just told them about the money in my account that is gone and they don’t say much but they can’t do anything because it is completed. It’s annoying and I can only imagine how many people has had money taken from them.
