Akumin Corp. bears responsibility for an October cyberattack that compromised its network and led to a data breach, a new class action lawsuit alleges.
Plaintiff Fred Baker claims data security failures on behalf of Akumin allowed hackers to access personally identifiable information and protected health information stored on the company’s network.
The plaintiff argues Akumin ultimately failed to properly safeguard, secure and adequately destroy consumers’ “sensitive personal identifiable information that it had acquired and stored for its business purposes.”
“The Data Breach was a direct result of Defendant’s failure to implement adequate and reasonable cyber-security procedures and protocols necessary to protect individuals’ Private Information with which it was entrusted for either treatment or employment, or both,” the Akumin class action states.
The plaintiff wants to represent a nationwide class and Florida class of individuals whose private information was compromised in the Akumin data breach.
Akumin allegedly ‘disregarded’ the rights of individuals affected by October data breach
The plaintiff claims Akumin “disregarded” the rights of himself and other class members by allegedly “intentionally, willfully, recklessly, and/or negligently failing to take adequate and reasonable measures to ensure its data systems were protected against unauthorized intrusions.”
The data breach exposed sensitive information, potentially including names, email addresses, phone numbers, Social Security numbers and health insurance and other medical information, among other things, the Akumin class action alleges.
The plaintiff claims Akumin is guilty of negligence, negligence per se, breach of implied contract, breach of fiduciary duty, breach of confidences and unjust enrichment and of violating the Florida Deceptive and Unfair Trade Practices Act.
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, statutory and treble and/or punitive damages for himself and all class members.
A similar class action lawsuit was filed against Comcast Cable Communications LLC earlier this month by a consumer arguing the company failed to have adequate cybersecurity safeguards in place to protect its customers’ sensitive information during an October data breach.
