Wawa Data Breach Class Action Settlement Overview: 

  • Who: Wawa and plaintiffs in a 2019 class action against the company are calling on the courts to approve a $3.2 million payment to the class attorneys.
  • Why: The payment is part of a $12 million settlement that closes out a 2019 data breach class action lawsuit.
  • Where: The case is being litigated in Pennsylvania.

Wawa customers who sued the company over a 2019 data breach are asking for approval of attorney fees as a part of a multimillion dollar class action settlement.

The $3.2 million is part of a $12 million settlement Wawa reached with the plaintiffs this year, which will see customers get $8 million worth of Wawa gift cards and up to $1 million in cash payments for those who can prove out-of-pocket losses. 

According to the customers, the lump payment for the attorneys will be divided up into $3.04 million for attorney fees, $45,940 for litigation expenses, about $100,000 for the party settlement administrator, and $1,000 for each of the class representatives.

$12M Wawa Data Breach Class Action Settlement

The $12 million class action settlement closes out a December 2019 lawsuit that was filed after Wawa discovered malware on its payment processing servers that had been potentially exposing customer payment card information at most of its locations since March 4 2019.

The viruses collected payment card information and transmitted it to hackers, who then sold the information on the dark web. Wawa has almost 900 locations, including fuel dispensers, which were targeted in the attack.

In the proposed settlement, customers will fall into one of three class groups. The first group includes those who bought something at Wawa using their credit or debit card between March 4 and Dec. 12, 2019 and spent time monitoring their account because of the breach. Those Class members will get a $5 gift card. 

The second is for customers who made a purchase and can submit proof of a fraudulent charge or attempted charge, in exchange for a $15 gift card.

The third is for customers who can show any losses suffered as a result of using their card at Wawa during the security breach. Those members can get up to $500.

Wawa was hit with a series of class action lawsuits following the 2019 data breach, which were consolidated in 2020. 

The convenience store is also facing a class action lawsuit from a former employee who alleges that the company fired him in the wake of the cybersecurity attack.
