The personal information of more than 330,000 Medicaid health care providers in Ohio was exposed by Maximus, Inc, a contractor for the state, in a May data breach, claims a class action lawsuit.  

Lead plaintiff, James Brickman, filed the nationwide class action lawsuit in Ohio federal court Friday. Maximus Inc and Maximus US Services, Inc, provide data management services to the Ohio Department of Medicaid. Brickman accuses the companies of failing to properly secure personal information of Medicaid providers, including names, birthdates, Social Security numbers, and Drug Enforcement Agency (DEA) numbers – including those who had left the state. 

Brickman, now a Florida resident, says that he was informed of the data breach by Maximus Inc on June 18, 2021. Allegedly, cybercriminals accessed his and approximately 334,690 other Medicare providers registered with the state between May 17 and May 19 of this year.  

The plaintiff, a Registered Nurse (RN) claims that his credentialing information from more than two decades ago when he worked in Ohio was compromised in the data breach. He says that after being informed of the breach, he spent hours reviewing his credit score, bank accounts, and other financial information for abnormal activity.  

“Mr. Brickman also faces an increased risk that someone may use his DEA number to impersonate him for the purposes of billing ODM for services or for writing prescriptions,” points out the class action lawsuit. “This unique risk further exacerbates the risk of identity theft posed by the compromise of his Social Security number.” 

Brickman accuses Maximus Inc of failing to properly protect the personal information it receives about Medicare providers as a part of its contract with the state of Ohio. The plaintiff points out that the company was obligated under state and federal laws to protect this data.  

“Maximus’s data security obligations were particularly important given the substantial increase in cyberattacks and data breaches in the healthcare and government contracting industries preceding the date of the Data Breach, as well as given the incredibly sensitive nature of [personal information] that it retained on its servers,” alleges the class action lawsuit.  

In addition to allowing cybercriminals to access its systems, the plaintiff accuses Maximus of failing to detect the data breach. Brickman says that he and other Medicare providers now face an increased risk of identity theft and fraud.  

The plaintiff wants to represent other Medicare providers nationwide whose personal information was compromised in the Maximus Inc data breach, along with a Florida subclass.  

The class action lawsuit wants Maximus Inc to pay Class Members for any losses, as well as damages, attorney, and court fees.

    I too also recieved a letter for each one of my son’s from MAXIMUS stating that some of my minor’s info was involved in an incident involved critical vulnerability in MOVEIT Transfer in May of 2023.
    Please ADD ME to this lawsuit.

      I received a letter saying my personal info as well as the info of my children was involved in the data breach and was given an engagement number for said breach . I would like to join the lawsuit .
